공법에 있어서의 경제적 보수주의와 경제적 자유주의의 순환 = 경제공법에서의 패러다임의 재성찰

국문 초록 (Abstract)

2008년 세계 경제위기는 학문의 세계에 그때까지의 편향을 각성시키는 계기가 되었다. 이 글은 1989년 동유럽 러시아 혁명 이후 각성된 그때까지의 학문적 편향과 동아시아 외환위기 때 각성된 편향을 보고 난 뒤 2008년 세계 금융위기를 계기로 나타난 그때까지의 학문적 편향을 다룬다. 객관적 기준은 1930년대의 세계 대공황의 경험이 경제학과 법학에 각인된 아메리카의 공법제도사이다. 공법의 역사에서 이미 공인된 경제적 보수주의 대 경제적 자유주의의 주기적 순환이 1980년대의 레이거노믹스 이후 경제학과 법학에서 잊혀져 온 것을 지적한다. 논문저자는 역사적 사례를 들어 신자유주의 이후 세계 제2차 대전 종전 이후에 문명국의 기본법 제도의 기본이 된 자유주의의 의미가 왜곡되어 왔다는 것을 지적한다.

다국어 초록 (Multilingual Abstract)

World economic crisis of 2008 has given a chance that academic world can recognize hitherto academic stereotypes. This paper deals with academic stereotypes recognized 1) after East-European and Russia Revolution of 1989 and 2) after East-Asian crisis of foreign exchange and finally after 3) the meltdown of financial institutions in U.S. and other Western countries. How can we know academic stereotypes in social sciences, economics and law? Is there any objective standard to measure them? The author cites history of U.S. constitution, along with accumulations of economic and social history because integrative history reflect the times of world economic crisis of 1930`s through economics and jurisprudence. Before Reaganomics period, it had been well-known fact and wisdom that the period of economic conservatism and the period of economic liberalism moved in a cycle. This paper points out the circulation of two interactive legal and economic trends and philosophies has been forgotten since 1980`s neo-conservatism times.
