우리나라 가정법원의 현황 -성년후견제도의 도입 및 후견법원 설치를 위하여- = The Present Situation of the Family Court in Korea -For the Introduction of the Adult Guardianship and the Guardianship Court-

다국어 초록 (Multilingual Abstract)

Korea had entered into the aged society and the number of elderly people in Korea who have mental or(and) physical disorder has increased rapidly. Thus to guarantee them a right of human worth and dignity and of pursuing of happiness the introduction of the adult guardianship must be requested. Trying to enact for it in Congress was done but failed to bear a fruit. Sooner or later, however, the adult guardianship will be introduced. In preparing an introduction of it in Korea it also is important to note that not only the legal systems but also family court system to handle the case should be fully established. Nonetheless the current family court system does not well worked. A flood of divorce cases and it`s related cases, e.g. the division of property on divorce and child custody case, now lays a heavy burden on the court. Especially the shortage of expert judges and inspectors made the situation of family court system worse. The problems must be solved for the introduction of the adult guardianship.
