    이 글은 1919년 ILO 제1호 협약이 설정한 1일 8시간제의 역사적 의미를 출발점으로 삼아, 노동시간 규제가 임금 조정이나 노사 간 합의의 대상이 아니라 노동조건의 인간화와 건강ㆍ안전 보호를 핵심 이념으로 형성되었음을 재확인하는 문제의식에서 출발한다. 특히 24시간 경제, 플랫폼 기술, 즉시적 주문ㆍ응답 구조의 확산이 야간노동을 예외적 노동형태에서 상시적 노동형태로 전환시키고 있다는 현실을 전제하면서도, 야간노동 증가의 보다 근본적인 원인은 노동시간 규제의 성격 변화에 있다고 보았다. 초기의 야간노동 제한이 과로와 산업재해를 전제로 한 금지ㆍ억제 규범이었다면, 노동시간 규제가 임금 가산과 결합되는 과정에서 야간노동은 점차 보상 가능한 노동으로 재구성되었고, 탄력적ㆍ선택적 근로시간제의 확산은 주간과 야간의 구분, 연속 휴식의 중요성을 약화시키며 장시간ㆍ야간노동을 합법적 인력활용 선택지로 만들었다고 주장하였다.
    아울러 근로기준법 중심의 노동시간 규제가 협의의 근로자 개념에 종속됨으로써 플랫폼ㆍ특수고용 노동자를 구조적으로 배제하고 있다는 한계를 지적하였다. 알고리즘에 의한 배차ㆍ평점ㆍ제재와 소득불안정이 장시간ㆍ야간노동을 유도함에도, 자율성 담론은 이를 개인 선택의 결과로 환원하고, 근로자성 판단은 사후적ㆍ개별적 분쟁에 머물러 예방적 규율을 제공하지 못한다고 보았다. 이에 노동시간을 보상의 문제가 아니라 건강과 안전의 문제로 재위치시키고, 산업안전보건법의 위험관리 논리를 확장해 노무제공 형태를 불문하고 장시간ㆍ야간노동을 규율하는 새로운 노동시간 규제 패러다임을 모색할 것을 주장하였다.

    This article starts from the historical significance of the eight-hour workday established by the ILO Convention No. 1 of 1919 and reaffirms the understanding that the regulation of working time was originally conceived not as a matter of wage adjustment or collective bargaining, but as a core instrument for the humanisation of labour and the protection of workers’ health and safety. While acknowledging that the expansion of a 24-hour economy, platform technologies, and systems of instant ordering and response has transformed night work from an exceptional form of labour into a routine one, the article argues that the more fundamental cause of the increase in night work lies in the transformation of the nature of working time regulation itself. Whereas early restrictions on night work functioned as prohibitive and deterrent norms grounded in concerns over overwork and industrial accidents, the integration of working time regulation with wage premiums gradually reconstituted night work as compensable labour. The spread of flexible and selective working time arrangements further weakened the distinction between daytime and nighttime work and the importance of continuous rest, thereby rendering long and night work a legitimate option for workforce utilisation.
    The article also identifies the structural limitations of a working time regime centred on the Labour Standards Act, which is dependent on a narrow concept of “employee” and consequently excludes platform workers and workers in special forms of employment. Despite the fact that algorithmic allocation, rating and sanction systems, together with income insecurity, systematically induce long and night working hours, the discourse of autonomy tends to reframe these conditions as matters of individual choice, while determinations of employee status remain confined to ex post, case-by-case dispute resolution and fail to provide preventive regulation. Against this background, the article argues for repositioning working time as an issue of health and safety rather than compensation, and for developing a new paradigm of working time regulation by extending the risk-management logic of occupational safety and health law to regulate long and night work regardless of the form of labour provision.
