The recent Supreme Court decision on January 27, 2022, 2021da265010 (hereinafter referred to as the target judgment) is a case of claiming compensation for damages due to a violation of the doctor's duty of explanation related to patient treatment and medical practice, and at the same time, goes beyond the doctor's explanation and explains the patient's This is the first judgment to deal with the time for full deliberation in consent. In this judgment, the precedent stated that ‘the doctor’s duty of explanation should be fulfilled with an appropriate amount of time until the medical treatment is performed. In this case, the original judgment dismissed the plaintiff's claim for violating the duty of explanation on the basis of the fact that there was an explanation, but the Supreme Court reversed and returned the judgment of the lower court, saying that it should have been considered and judged whether there was adequate time. Since medical practice is a process to protect the patient's life and body, the patient's right to self-determination must be recognized in the process and method of protecting it. However, since medical practice is made on the premise of medical expertise and experience based on it, it is always the doctor's role to provide such an explanation, and it was difficult for the patient to recognize and understand it before medical practice. For a long time, it was not mandatory to listen to an appropriate doctor's explanation and the doctor's judgment was fully respected (benevolent interventionism). was compulsory and enacted. In addition, whether the doctor's duty to explain was to explain the expected aftereffects of medical practice was reviewed (information-based consent theory). Although this approach dramatically improved the protection of the patient's right to self-determination, there were also concerns about the formalization of the duty to explain. It raised a problem about the case of overlooking the explanation of a simple list, not the explanation for mutual communication, or whether the patient consented. Accordingly, the mere fact that there was an explanation from the doctor in medical practice cannot be said to have fulfilled the duty of explanation, and the obligation to obtain the patient's consent began to be stipulated. An example is the obligation to obtain the patient's consent from a doctor in Article 24-2 of the Medical Act. Efforts have also been made to effectively protect the patient's right to consent. Article 10-11, Paragraph 2 of the Enforcement Decree of the Medical Law Enforcement Decree is an example of the principle of written method. Through this, it became possible for the patient who heard the explanation to think carefully about it and, if necessary, to review the explanation again and make a decision with detailed reference to it in order to fully fulfill the duty of explanation and obtain the patient's valid consent. This deliberation process of the patient inevitably requires time. In the target judgment, it is reasonable in that respect. Time margin means securing absolute time first (formal meaning of time to ponder). However, the meaning should not be regarded as simply securing quantitative time uniformly. In particular, the practical meaning of the fact that the patient has time to ponder after hearing the advice is that the patient's cognitive ability and language ability should be considered in specific cases for the patient's time to recognize and understand themselves, and the patient should ask around and seek advice. It is also necessary to have room to receive counseling (shared decision-making theory). In all these processes, the patient should be free from pressure or worry about the disadvantages of not giving consent. For this purpose, it is necessary to practically consider various situations and standards, such as the standards of doctors described, standards of patients being considered, and standards of the general public. In addition, if...
