    Ancient concept of ex aequo et bono means that judge resolve the dispute according to fairnress and good conscience. The range of ex aequo et bono is dominant customs and usages of the trade (external constraints) not legal rules. Ex aequo et bono is provided in most related national law and international legal instruments as the applicable law. The important factor governing Ex aequo et bono decision is complying with practical reasonableness. Reasonableness is applying to relevant customs and practices and preserving expediency of arbitration proceedings. This is to follow with the concept of common sense, fairness and expediency not with explicit principles and legal rules. Ex aequo et bono operating in parties` freedom, autonomy and building trust with arbitrators, may lead to just decision. Ex aequo et bono can be said the best solution of conflicts as harmony of the 3 principles of party autonomy, justice and good faith(pacta sunt servanda) which govern international trade kaw and private law. As a saying "a good arbitrator is a good arbitration", success of ex aequo et bono depends on arbitrator`s conscience, independence and impartiality in the end.
