This article examines the legal and institutional restrictions on the rights of self-organizing and personnel administration of local government and suggests some policy alternatives to resolve them after discussing directions to response the trends of decentralization The rights of self-organizing and personnel administration should be transferred to base on self-regulations by local government instead of executive orders of central government but also to adopt the ceiling system of personnel expenditure and public announcement system on performance according to the principle of self-responsibility. Also, it should be reinforced the internal control system like the check function of local assembly, NGO and citizen participation in the level of local government and the function of diagnosis and assesment in the level of central government.
