직업재활시설의 마케팅을 위한 우선구매제도 적용방안 = A Study on the Enforcement Regulations of Procurement System for Persons with Significant Disabilities

국문 초록 (Abstract)

본 연구는 중증장애인들의 고용기회제공과 직업재활시설의 마케팅을 위해 제정된 중증장애인 생산품 우선구매 특별법이 직업재활시설의 마케팅을 위한 우선구매제도로 정착될 수 있도록 방안을 마련하기 위하여 실시되었으며 연구결과를 요약하면 우선구매제도가 중증장애인들의 보호고용기회를 제공하고 직업재활시설의 마케팅 방법으로 활용되기 위해서는 첫째, 이행장치를 보완해야 한다. 즉, 우선구매 촉진계획이나 우선구매촉진을 위한 실적 제출, 공공기관에 대한 시정요구, 구매품목과 비율의 사전 규정 등의 방법을 통해 이행장치를 강구해야 한다. 둘째, 우선구매촉진위원회의 운영에 관한 세부적인 사항을 규정하여 의결기구로서 역할을 할 수 있도록 해야한다. 셋째, 중증장애인생산품 시설의 지정절차 및 요건을 규정하여 우선구매제도의 불합리한 운영을 사전에 예방하도록 해야 하며, 넷째, 중증장애인생산품 품질인증의 절차 및 인증기준, 품질인증기관의 지정과 인증서 발급, 취소 등에 관해 규정함으로 중증장애인생산품에 대한 질과 양을 통제하여 동 법률의 제정취지를 보호할 필요가 있다. 다섯째, 중증장애인생산품 업무수행기관 지정에 대해 대상기관을 (사)한국장애인직업재활시설협회로 규정하고 필요한 지원을 규정하며, 여섯째, 기타 이 법률에 근거하여 필요한 지원방안을 규정할 필요가 있다. 마지막으로 이 법률이 소기의 성과를 거두기 위해서는 장기적인 측면에서 개정이 필요하다.

다국어 초록 (Multilingual Abstract)

The purpose of this study is to develop the enforcement regulations of procurement system for Persons with Significant Disabilities. The Procurement Special Act for Persons with Significant Disabilities provides employment opportunities for nearly 10,000 persons who have severe disabilities by orchestrating government purchases of products and services provided by nonprofit agencies employing such individuals throughout the country. The result of this research can be summarized as follow;
First, to strengthens an execution system of procurement regulations for Persons with Significant Disabilities.
Second, the Committee for Purchase From People Who Are Severely Disabled must do in order role as the decision organization, Thus, must provide the detail fact regarding the operation of the Committee.
Third, to maintain its qualification under the Special Act, each nonprofit agency authorized to furnish a commodity or a service shall continue to comply with the requirements of a "nonprofit agency for other severely handicapped”. In addition, each such nonprofit agency must submit to its central nonprofit agency two completed copies of the appropriate annual certification covering.
Fourth, to be specified in the law encouraging quality certification system and supporting related activities.
Fifth, Korea Association of the Vocational Rehabilitation Facilities for the Disabled is a necessity which it will designate as Business accomplishment agency for Persons with significant Disabilities.
Finally, The support plan preparation which is based to this law and the law opening a court are necessary.
