한국, 미국 및 일본 발달장애인법 비교: 장애인 정책의 핵심 개념에 기반한 비교 분석 = Comparative Analysis of Developmental Disabilities Act among Korea, America and Japan: Based on Core Concept of Disability Policy

다국어 초록 (Multilingual Abstract)

This study was to analyse Development Disabilities Act among Korea, the United States(California State, Lanterman Act) and Japan, in accordance with 18 core concepts of disability policy Turnbull and Stowe(2001) proposed and 25 sub-analysis of disability policy researchers developed.
As a result, Lanterman Act reflects the core concepts of disability policy well, and developmental disabilities act of Korea and Japan was the next order.
Lanterman Act was presented to all the provisions applicable to the core concepts of disability policy 18. And concerning the 25 sub-analysis of the compliance obligations of citizens, awareness, income enhancement, productivity contribution of the whole society, to encourage research and development did not prescribe a separate provision. On the other hand, Korea Development Disabilities Act was found to reflect the 14 key concepts, except for four key concepts such as capacity based services, cultural responsiveness, freedom, privacy protection provisions of the law.
Developmental Disabilities Act of Japan reflects 14 of the core concepts in each of provisions of the law. Intellectual Disabilities Welfare Act of Japan reflect 6 core concepts. Based on the comparative analysis suggested an improvement Korea Development Disabilities Act requirements.
Findings of this study will be contributed to provide basic information about the current level and future direction of the legislation of korea developmental disabilities act, analyzing developmental disabilities act of each of nation in accordance with the criteria of the core concepts of disability policy.

국문 초록 (Abstract)

이 연구에서는 한국, 미국 및 일본의 대표적인 발달장애인 관련 법률인 한국 발달장애인법, 미국 캘리포니아주의 랜터만법 및 일본의 발달장애인지원법과 지적장애인복지법을 Turnbull과 Stowe(2001)이 제안한 장애인 정책의 18개 핵심 개념 및 연구자가 자체 제작한 25개 하위 분석 준거에 따라 비교, 분석하였다.
그 결과 미국 랜터만법, 한국 발달장애인법, 일본 발달장애인지원법, 지적장애인복지법 순으로 장애인 정책의 핵심 개념을 잘 반영한 법률인 것으로 나타났다.
미국 랜터만법은 18개의 장애인 정책의 핵심 개념에 해당하는 조항을 모두 제시하고 있었고, 25개의 하위 분석 준거 중 국민의 책무, 인식 개선, 소득 증진, 사회 전체의 생산성 기여, 연구․개발 장려에 관한 사항은 별도의 조항으로 규정하지 않았다. 반면 한국 발달장애인법은 능력기반서비스, 문화적 반응성, 자유, 사생활 보호 등 4개 핵심 개념을 제외한 14개 핵심 개념을 법률의 조항으로 반영하고 있는 것으로 나타났고, 일본 발달장애인법은 14개, 지적장애인복지법은 6개의 핵심 개념을 법률의 조항으로 각각 반영하고 있었다. 이와 같은 비교 분석 결과를 바탕으로 한국 발달장애인법이 개선, 보완되어야 할 사항을 제시하였다.
이 연구는 한국, 미국 및 일본 발달장애인법을 비교함으로써 국내 발달장애인법의 현행 수준과 미래의 입법 방향에 대한 기초 자료를 제시하였다는 점에서 의의가 있다.
