동성애자에 대한 사회적 법적 고찰

국문 초록 (Abstract)

벨기에, 캐나다, 네델란드, 스페인이 동성애자들에게도 합법적인 혼인을 할 권리를 부여하고 있는데 반해, 미국은 최근에서야 캘리포니아주와 매사추세츠주와 같은 몇 개의 주에서 동성애자의 혼인에 대해 이성간의 혼인에서 부여받는 것과 동등한 권리를 인정하고 있다. 우리나라에서도 동성애자와 동성간의 혼인에 대한 활발한 논의를 통해서 그들을 보호할 수 있는 방안을 마련해야 한다.
그리고 성적 정체성의 형성시기에 있는 청소년기의 동성애자들에 대한 대책과 보호는 한 사람의 사회적 미래와 생명과 관계되는 문제이다. 이이에 대한 법적 규제보다도 더 시급한 것은 그들에 대한 인식변화와 사회적 보호책 마련이다
이성애자가 주류를 이루는 현대 사회에서 동성애자들은 푸코가 지적했듯이 비정상인으로 분류될 지도 모른다. 그렇다면 그들은 성경적 금기와 "타인에 대한 사랑"이라는 보편적 신의 명령과 어떻게 조화될 수 있을까. 성경적으로 금기되었다는 것만으로 그들의 인권이 보호받지 않는다는 것을 의미하지는 않으리라 여겨진다. 그러한 점에서 기독교적 관점에서 동성애의 문제를 연구하더라도 동성애자의 인권을 보호하는 한도 내에서는 그들에게 관대한 대우를 해주는 것이 바람직하다.

다국어 초록 (Multilingual Abstract)

Many Countries, including Belgium, Canada, Netherlands, Spain provide a right to marry to same-sex couples. In the United States, a right to marry is recognized in a few states such as California and Massachusetts. It should be also prepared the way to protect same-sex couple and same-sex marriage in Korea.
Moreover, cosidering the sexual orientation is formed in an adolescent period, the protection of juveniles is very important to our future of society.
In modern society, a homosexual or a lesbian is often treated as abnormal as Foucault pointed out. It is also not consistant with the teaching written in the Bible. However, it is desirable to protect same-sex couple's rights if their sexual orientation cannot be changeble and it is very hard to live under current legal and social system from the point of view of human rights.
