공공서비스의 역사적 변천과 특성 - 우리나라의 공공서비스 법제에 관한 내용분석 - = The Historical Change and Trait in Public Service - Focused on Content Analysis of Public Service Law in Korea -

다국어 초록 (Multilingual Abstract)

The purpose of this study is to analyze the historical change and trait through law related to public service during the 1953-2008 period. Based on the analysis, this paper suggests several implications for historical trait of public service law in Korea. First, the service's patterns hold relatively a majority in education, medicine, welfare, police, culture-art services of all law. Second, it is showed that the change of law is frequent a water-resource, medicine, education services, as attended on demand of service. Third, the pattern of law's chance is highlighted with education service before the 1970's, education and medicine in the 1970's, culture-art and medicine in the 1980's, education and culture-art in the 1990's, water-resource and medicine in the 2000's. Four, the contents of law's change focus on standard arrangement and institution creation in production for public services, establishing organization to service delivery. Five, it is dominant pattern that supply types of service place the focus on public-supply in the police, railway, disaster control, civil service, on public-supply, privatization and public-private partnership in the education, culture-art, medicine, welfare service, on public-supply and privatization in the water-resource, waste management service. Finally, we suggest that historical approach of public service law in Korea provides a peculiarly pivotal framework for public service studies. Despite such argument this paper is a basic study in the level of exploratory research.

국문 초록 (Abstract)

본 연구는 최근 국내외적으로 활성화된 공공서비스 관련 선행연구들이 서비스 측정과 평가를 중심으로 괄목할만한 연구성과를 산출하고 있음에도 불구하고, 공공서비스에 관한 법제도적 접근은 상대적으로 미약하다는 점에 착안해 우리나라 공공서비스 법제의 경향과 내용을 분석하였다. 이를 통해 도출한 주요 분석결과는 다음과 같다. 첫째, 공공서비스 법률 중 교육, 의료, 복지, 문화예술, 경찰서비스가 다른 분야 법률보다 상대적으로 다수이다. 둘째, 법률 제․개정은 수자원, 의료, 교육서비스가 다른 법률보다 빈번한 편이며, 이들 서비스는 행정수요에 따라 새롭게 대응하여 변천하는 모습을 표출하였다. 셋째, 법률변화의 추이는 1970년대 이전 교육, 1970년대 교육, 의료, 1980년대 문화예술, 의료, 1990년대 교육, 문화예술, 2000년대는 수자원, 의료서비스 등이 부각되었다. 넷째, 법률체계는 공공서비스 분야별 법제형성과 재정비 시기에 법률은 뚜렷한 차이가 나타났다. 가령, 철도서비스는 법제형성 시기에 철도 개념이 고정적 서비스인 반면에 1990년대에 철도 다양성(도시, 고속철도, 공공철도 등)으로, 복지는 사람에서 제도중심으로, 수자원은 인프라설치에서 주민지원중심으로 변화이다. 다섯째, 법률개정 내용은 서비스생산기준 구체화, 전달기구 신설, 생산제도 신설 등에 초점이 부여되었다. 여섯째, 공공서비스 공급유형은 경찰, 민원, 철도, 재해관리서비스는 공공 공급형이, 교육, 문화예술, 의료, 복지, 식품위생은 공공 공급형과 공공․민간 병행공급형, 민간위탁형이, 우편, 주택, 통신은 공공 공급형과 공공․민간공급 병행형이, 수자원과 폐기물은 공공 공급형과 민간위탁형 등이 지배적 패턴으로 나타났다.
