제6조 시장메카니즘에 관한 파리이행규칙의 평가와 시사점 = The Analysis of the Paris Rulebook and Its Implications for International Greenhouse Gas Emissions Trading Markets

국문 초록 (Abstract)

이 논문은 종합적인 시각에서 새로운 기후변화체제를 평가하고 전망하기 위해 파리협정이 추구하는 야심찬 목표와 환경적 건전성의 관점에서 제6조 시장메카니즘에 관한 파리이행규칙의 주요내용을 분석·평가하는 것을 주된 목적으로 하고 있다. 그리고 이를 바탕으로 국제배출권거래시장에 대한 향후 전망과 정책적 시사점을 도출하고자 한다.
제6조 시장메카니즘은 파리협정 제6조에서 규정한 대원칙인 더 큰 야심, 지속가능한 발전, 환경적 건전성이라는 대원칙에 따라 충실하게 설계되었다. 특히 NDC의 범위와 사용목적을 불문하고 ITMOs의 모든 거래에 상응조정을 적용하고 거버넌스의 투명성을 보장함으로써 국제배출권거래시장의 확대를 추구하고 있으며, 협력적 접근과 SDM과의 관계를 명확히 하고 있다. SDM의 경우, 감축분의 신뢰성을 확보하기 위해 기준배출량 산정과 추가성의 판단에 있어 엄격한 방법론을 적용하고 있고, 지속가능한 발전을 촉진하고 토착민 등 지역주민의 인권과 복지를 보호할 수 있는 여러 기준과 절차를 마련하고 있다.
모든 경우에 유치국의 승인이 있어야 감축분이 ITMOs로 전환될 수 있기 때문에 자국의 NDC를 달성하는데 사용하기 위해 유치국은 승인하지 않거나 ITMOs의 수량을 제한할 수 있어 온실가스 감축사업을 추진할 때 사업자나 국가가 직면할 수 있는 리스크가 된다. 유치국의 NDC와 관련 법제에 대한 면밀한 검토가 있어야 하며, 협력적 접근에 관한 협약을 체결할 때에는 협약서에 승인의 기준과 절차 및 법적 책임에 관해 명확하게 규정하여 사업의 리스크를 최소화하고 분쟁을 예방할 필요가 있다. 그리고 현재 절대 다수의 국가들이 추진하고 있는 협력적 접근은 SDM과 유사한 상쇄방식의 배출권거래제이므로 이를 시행하려면 거버넌스와 인프라를 사전에 구축해야 한다. 법과 제도, 정책을 수립하여 제도적 기반을 마련하고 지식과 기술을 습득하고 인력을 양성하는 등 역량도 키워야 한다. 특히 유치국이 되는 후진국들의 경우 역량과 재원이 부족한 것이 현실이다. 이 점을 고려하여 선진국들은 일반적으로 공적 원조(ODA) 등 재정지원과 연계하고 역량 강화를 지원하는 방식으로 협력적 접근을 설계하고 있다. 일본이 주도하는 JCM은 공동위원회를 중심으로 한 중앙집권적인 거버넌스를 채택하고 있으며 오랜기간 시행한 경험을 바탕으로 활동의 설계부터 ITMOs의 발급·거래까지 활동주기 전반을 뒷받침하는 인프라를 구축하고 있다는 점에서 단연 협력적 접근의 모범사례이다. 여러 가지 측면에서 우리나라를 비롯한 신흥개발국가가 추구해야 할 역할 모델로 평가할 수 있다.
협력적 접근과 SDM은 별개의 제도이지만, SDM의 거버넌스와 방법론은 중요한 참고사항이 될 것이다. 따라서 SDM이 선도하면서 협력적 접근과 SDM은 시간이 지남에 따라 상호 접근해 나갈 것이며, 장래에는 총량관리방식의 국제배출권거래시장이 출범하여 상호 연계되어 시행될 것으로 예상된다. 이와 동시에 감축분의 신뢰성과 거버넌스의 투명성을 강화하기 위한 자발적 탄소시장의 표준화작업이 진전됨과 동시에 과학 기반 목표에 근거하여 기업들이 자체적인 온실가스 배출량을 감축시켜 나간다면 하나로 통합된 국제배출권거래시장이 언젠가 등장하게 될 것이다. 그러나 시장메카니즘이 당초 취지대로 파리협정의 야심찬 온도목표를 실현하는데 크게 기여하려면 탄소시장 간 연계와 ...
