연쇄강간범의 범행특징과 대응방안 = A Study on the Crime Characteristics & Countermeasures of Serial Rapists -Centered on so-called 'Balbari' Cases-

The purpose of this paper is to clear crime characteristics and countermeasures of serial rapists. To achieve this purpose, the writer examined definitions of research subjects and modus operandi of serial rapists, and described methods to presume crime motive by serial rapist's action analysis. Furthermore, the writer tried to clear serial rapist's characteristics analyzing crime cases. Common crime characteristics of serial rapists can be arranged by eight. First, serial rapists are sole offender. Second, serial rapists aims at singleness house or villa of 1 - 4 floor. Third, many serial rapists make strangers to their crime target. Fourth, invasion time is various according to surrounding situations. Fifth, when rape, sufferers experience serious horror. Sixth, serial rapists plunder mainly cash. Seventh, serial rapists practice various method to avoid arrest. Eighth, serial rapists have high possibility of sexual deviance and psychopath. The most important characteristics that appear at crime are mediation, domination and control about victims. To prevent and cope serial rape, victims(latent victims) must take care of to protect themselves and prepare various crime equipments. Local community must try to protect themselves from intruder. The police must arrest offender rapidly through interviews and follow-up investigation.

국문 초록 (Abstract)

본고는 최근에 기승을 부리고 있는 '발바리'의 범행특징을 분석하고 이에 대한 대응방안을 제시하기 위해 2004년 이후에 해결된 사건들 중 수사기관의 협조를 얻을 수 있었던 사례들을 분석하였다. 각각의 사건들을 실제 수사한 경찰과 범죄분석가를 심층면접함으로써 사건의 본질에 보다 심도 있게 접근하고자 하였다.
연구결과를 종합해 보면, 연쇄강간범들은 단독으로 방범시설이 허술한 곳을 용이한 시간대를 골라 침입하여 전혀 면식이 없는 20-30대의 여성들을 집중적으로 노렸다. 성폭행 과정에서 피해자에 대한 지배ㆍ조정ㆍ통제가 강했고 주로 현금만을 강취하며 다양한 검거회피전략을 구사했다. 이런 '발바리들'은 파렴치범이자 직업범죄자인 셈이다. 즉, 이들은 비교적 범행이 용이한 장소와 대상을 골라 직업적으로 강ㆍ절도를 행하고 강간을 자행한 자들이기 때문이다.
강간범들의 주요 타깃은 아는 사람들이다. 그러나 연쇄강간범은 면식관계가 전혀 없는 사람들을 목표로 삼기에 피해자는 가해자와 아무런 연관이나 접촉이 없었다는 점에서 그들에 대한 비난이나 역할의 문제를 제기하기 어렵다. 또 이들의 범행이 금품의 강취와 성폭행이기 때문에 피해자들은 수사기관에 의한 2차 피해와 성적 수치심 및 가정파탄의 우려로 신고를 꺼리게 된다. 이러한 점들이 바로 '발바리들'의 연쇄성폭행이 지속되는 가장 중요한 이유이자 피해자들을 보호해야할 과제이다.
이들 연쇄강간범의 범행에 대응하기 위해 피해자(잠재피해자)는 스스로를 보호할 수 있는 세심한 주의와 방범장비를 갖출 필요가 있다. 피해 시에는 신속히 신고하여 이들에 의한 연쇄 범행으로 다수의 무고한 피해자가 생기지 않도록 수사기관에 적극 협조해야 한다. 지역사회는 '이웃알기 운동'을 전개하여 공동으로 대응하고 수사기관에 협조해야 할 것이며, 경찰은 이런 파렴치범들에 의한 범행이 지속되지 않도록 순찰을 강화하고 탐문수사와 과학수사 기법을 활용하여 최대한 단시일 내에 검거할 수 있도록 전담팀을 만들어야 할 것이다.
