이슬람 후두드 형벌과 비례성의 원칙 = 절도죄의 신체절단형을 중심으로

국문 초록 (Abstract)

본 연구는 비례성의 관점에서 이슬람 후두드 형벌을 분석한 것이다. 그 주된 대상은 신체절단형을 규정한 절도죄에 관한 것이다. 후두드 절도의 적용에 대해서는 실체법적 측면과 절차법적 측면, 후두드 법언을 통한 제한이 있었다. 이는 신체절단형이라는 형벌의 중대성과 절도에 의한 법익의 침해 사이에 균형을 이루기 위한 것으로 비례성의 원칙을 따른 것이라고 할 수 있다. 이슬람법에서의 비례성은 실체적 요소와 절차적 요소가 결합되고, 종교적 권위에 바탕을 둔 특징을 보인다.

다국어 초록 (Multilingual Abstract)

The principle of proportionality is one of the most essential factors for dispensing criminal justice in a society. Islamic law recognizes the principle of proportionality, even in the punishment of amputation for those who commit Hudud theft. Islamic jurists narrowed down the definition of Hudud theft so that the severity of the punishment would reflect the degree of harm caused by the crime. In addition to this, they developed strict requirements for Hudud theft in the rules of evidence. The combination of substantial and procedural proportionality is a distinctive characteristic of Islamic law. It is the result of Islamic jurists" efforts to dispense criminal justice without damaging religious authority.
