The ultimate goal of armed conflict is military victory. Military victory requires strong offensive capabilities to destroy adversaries in armed conflict. In this context, competition among States is intensifying for the development and creation of enhanced soldiers, so-called super soldiers. Enhanced soldiers are created through biochemical enhancement, cybernetic enhancement, and prosthetic enhancement, and each country is investing lots of technologies and materials into biotechnology and military technology with regard to enhanced soldiers. Enhanced soldiers give rise to the issue challenging the interpretation of black letter law of the law of armed conflict. Issues such as whether biochemically enhanced soldiers can be considered as biological weapons per se, whether enhanced soldiers also can be regarded as means and methods of warfare as tools or instruments delivering attacking capabilites, are relevant examples that enhanced soldiers can raise. Whether the employment of illegal weapons, means and methods of warfare causing superfluous injury or unnecessary suffering to enhanced soldier can be justified in terms of military interests can be the most difficult question related with enhanced soldiers. The evaluation of enhanced soldiers under the law of armed conflict should be made through a detailed exploration of the level of biotechnological technology related to enhanced soldiers, and reconsideration of black letter law of the law of armed conflict concerning the achievement of military purposes. In so far as enhanced soldiers are not just tools or instruments such as weapons, means and methods of warfare, even if military capabilities of enhanced soldiers explicitly surpass those of unenhanced soldiers, enhanced soldiers should be treated as human beings under the law of armed conflict. In case of an all-out war between enhanced soldiers and unenhanced soldiers, it is easy to predict that massive damages will be delivered to unenhanced soldiers. However, issues concerning enhanced soldier should not be approached only on the ground of military interests or purposes. For the purpose of dealing with issues of enhanced soldiers, in so far as the specific legal regime for enhanced soldiers is not prepared, the approach to enhanced soldiers should be proceeded along with the idea of humanity that is backbone of the law of armed conflict.
