신 발전국가의 민주주의 행정이론 = The Democratic Theory of Public Administration in the New Developmental State

This study explores the possibility of a democratic theory of public administration in the developmental state in the Korean context. To summarize the results of the study, the Korean developmental state has achieved the goals of economic development, but it has been criticized as oppressive of freedom and abusive of authority, with authoritarian control of the internal administrative process, and which conflicts with democratic values. In order to solve these problems, it is necessary to examine the relationship between the developmental state and liberal democracy. The rule of law and democratic theory of public administration in a liberal democracy differs by country according to the historical context. Acknowledging the increasing role of public administration, the administrative state in the United States developed democratic administrative theories such as decentralization and participation, functional authority, and flexible organization and moreover strived to retrofit public administration to the values of the Constitution by utilizing the constitutional powers of the Congress and the judiciary. In contrast, European countries such as France and Germany designed the relationship between democracy and administration to be stable by stipulating it concretely under the Constitution. A new developmental administration paradigm can be constructed through the decentralization of the powers concentrated in the president, a constitutional guarantee of the specialization of administrative bureaucracy and functional authority, democratic social planning, an inclusive policy process, effective implementation, flexible and creative internal organization, securing a public interest spirit and job ethics for civil servants while maintaining rational goal setting by the state, and the capacity for the state to intervene selectively in the private sector.

국문 초록 (Abstract)

과거의 발전국가는 경제발전의 목표를 달성하였지만 자유의 억압과 권한 남용, 행정 내부 과정이 권위주의적인 통제와 조정에 의하여 움직인다는 점에서 민주적 가치와 상충되는 측면이 있었다. 이러한 문제점을 해결하기 위해서는 발전국가와 민주주의 및 법치주의의 관계를 규명할 필요가 있는데, 자유민주주의 하에서 민주주의 행정이론은 국가별로 역사적 맥락에 따라 차이가 있다. 미국의 행정국가는 행정의 사회적 역할이 증가함에 따라 행정의 정책결정권을 인정하는 대신에 헌법과 자유민주주의의 가치에 충실한 분권과 참여, 기능적 권위, 유연한 조직 등의 민주적 행정이론을 개발하고 행정부 이외의 의회와 사법부의 견제와 균형의 권한을 활용함으로써 행정권을 헌법에 충실하게 맞추려고 하였지만 프랑스와 독일에서는 기존에 역사적으로 형성된 유기적인 행정 관료제와 정치의 관계를 헌법에 명문화함으로써 민주주의와 행정의 관계를 안정적으로 설계하였다. 신 발전행정 패러다임은 발전국가의 핵심적 요소로 국가에 의한 합리적 목표설정, 효과적인 집행, 민간영역에 대하여 선별적 개입 역량은 유지하면서도 자유민주주의의 헌법 가치에 부합하도록 대통령에게 집중된 권력의 분산과 행정의 전문성에 대한 헌법적 보장, 민간이 제기한 사회문제에 대하여 국가가 포용하는 민주화된 사회기획, 이해관계자를 적극적으로 참여시키는 포용적 정책과정, 기능적 권위의 존중과 유연하고 창의적인 내부조직의 운영, 행정인의 공익정신과 직무윤리의 확보를 통하여 구현될 수 있다.
