친일반민족행위자재산 조사에 따른 地籍의 역할과 향후과제 = Cadastre’s Role and Future Tasks Related to the Pro-Japanese Antinationalist’s Property Investigation

국문 초록 (Abstract)

본 논문은 친일재산의 조사에 따른 지적의 역할과 향후 과제를 정리하였다. 친일반민족행위자의 재산조사 및 국가귀속업무는 역사적 정의구현과 민족정기를 바로 세우고자 하는 국가적 과업으로 지적부서의 ‘조상 땅 찾아주기 사업’이 계기가 되어 의원입법으로 친일반민족행위자 재산조사에 관한 특별법이 제정됨과 함께 시작되었다.
친일재산의 조사는 ① 친일반민족행위자의 선정 및 조사 ② 가계도 작성 ③ 친일 재산의 사전조사 ④ 조사개시결정 및 본 조사 ⑤ 국가귀속의결의 순으로 추진된다. 이 과정에서 지적은 지적전산시스템을 활용한 친일행위자 및 그 후손의 재산 조회와 대상 재산의 국가귀속을 위한 현지조사, 지적정리과정에서 발생한 특수한 사례를 처리하는 역할을 담당하였다. 이는 친일재산조사업무에서 큰 비중을 차지하며 매우 중요한 역할이라 할 수 있다.
이 업무를 마무리하면서 향후 지적재조사사업추진을 위한 국민공감대형성, 지적전산자료의 정비, 은닉국유재산의 조사업무 등 과제를 제시하였다. 이 논문이 지적업무의 중요성을 일깨우고 향후 지적의 발전과 선진화에 일조하기를 기대한다.

다국어 초록 (Multilingual Abstract)

This paper is organized with cadastre’s role and future tasks related to the pro-Japanese antinationalist’s property investigation (called it “the investigation” for short). The investigation and the reversion of pro-Japanese antinationalist (PJAN)’s property have been started with the establishment of special law on the investigation of pro-Japanese and antinationalist’s property. They were implemented to realize justice and to build national spirit taking the opportunity of “Project of Finding Ancestor’s Land” organized by the department of cadastre as one of the national projects.
The investigation has been processed in the order as follows: ① searching and investigating PJANs; ② constructing their family tree; ③ pre-investigating PJAN’s property; ④ determining the commencement of the investigation and executing the investigation; ⑤ judging its reversion or non-reversion. In the process of the investigation, cadastre has participated by inquiring into the PJAN and its offspring’s land by using the cadastral computing system and doing field-survey. Cadastre’s tasks have taken much weight in the total amount of investigation.
This Paper suggests a few further studies such as refinement of cadastral computing data, systematic investigation of national property hidden away, and the formation of public sympathy for the implementation of the cadastral reform project. It is expected that this paper can be helpful to make people realize the importance of cadastral tasks and to assist the development of cadastre.
