공경매토지 쟁점과 법정지상권 함의

국문 초록 (Abstract)

본 논문은 부동산 공경매 과정에서 빈번히 발생하는 현장조사의 주요한 쟁점을 중심으로, 이들 행위가 단순한 사적 권리분쟁을 넘어 공익을 침해하는 지를 민형사적으로 검토한다. 특히, 토지의 다양한 하자의 쟁점에서 법정지상권의 제도적 한계를 논의하고 판례 및 비교법적인 검토로 제도를 진단한다. 진단된 현장조사의 쟁점과 법정지상권의 문제를 민형사제도를 비교 분석함으로써, 그 적용 가능성과 한계를 강조한다. 공경매토지의 쟁점에서 제기된 한계와 법정지상권에 대한 문제의 해결방안으로 일괄경매청구권과 입법제안을 통하여 개선의 방향성을 제시하고자 한다.

This paper focuses on the major issues of on-site investigation that frequently occur in the process of real estate auction, and examines civil and criminal whether these actions violate the public interest beyond simple private rights disputes.,In particular, it discusses the institutional limitations of legal superficies in various issues of land defects, diagnoses the system through judicial precedents and comparative legal reviews, and emphasizes its applicability and limitations by comparing and analyzing the issues of the field survey and the legal superficies., As a solution to the limitations raised in the issue of land auction and the problem of legal superficies, we propose the direction of improvement through collective auction claim and legislative proposal.
