서구자유주의적 권리-의/책무개념체계에 대한 연구

국문 초록 (Abstract)

이 연구는 서구 자유주의적 권리개념과 이 개념에 대응하는 의무 및 책무개념(이하 의/책무개념)의 체계적 특성과 정치사회 질서개념으로서의 성격을 드러내 보이기 위해 시도된 것이다. 이 연구는 그간 이들 개념의 정치사회질서‘대상’으로서의 성격에만 초점을 맞추어온 기존 국내외 연구관행 속에서 등한시된 질서‘표현 및 구성’개념으로서의 성격을 조명해보는 새로운 시도로서의 의의를 가진다. 연구결과는 3가지로 요약된다. 첫째, 권리-의/책무개념체계가 사회 전 부문에 걸친 삶의 현재적, 잠재적 요구를 삶의 전개질서에 부합하게 구성하여 표현할 수 있음을 보여주었다. 둘째, 이 개념체계는, 서구자유주의사회(혹은 자유민주주의사회)의 사회관계질서를 개념관계질서로 구성하여 표현할 수 있음을 보여주었다. 셋째, 이 개념체계는 축차적, 중첩적 질서에 따라 구성되는 서구자유주의 정치사회질서체계를 개념위임질서체계로 구성하여 표현할 수 있음을 보여주었다. 이 연구는 2가지를 시사해준다. 첫째, 이 개념체계는 검토과정에서 자유민주주의 정치사회가 유기적으로 통합된 삶의 영역으로, 그 정치사회질서는 연속된 삶의 질서의 반영으로 이해될 수 있음을 시사해주었다. 둘째, 질서구성(확보와 형성)과 기능에서, 사적인 개인의 삶의 요구와 공적인 정치사회질서의 요구가 삶의 질서의 연속선상에서 상호 피드백관계에 있음을 시사해주었다. 더불어 이 연구는 권리-의/책무개념질서체계가 정치사회질서체계에 비하여 2가지 특장이 있음을 보여주었다. 첫째, 질서개념체계가 질서체계에 비하여 정치사회질서의 변화 및 생성과정을 보다 현실적으로 설명해줄 수 있다는 점이다. 둘째, 질서개념체계가 질서체계에 비해 현존 정치사회질서의 안정도에 대한 보다 구체적인 정보를 제공할 수 있다는 점이다.

다국어 초록 (Multilingual Abstract)

This study is to expose systemic and ordering characteristics of the Western liberal concepts of a right and a corresponding duty(obligation). It is somewhat a new attempt in that while the existing studies so far done have largely focused on these concepts as the resultants of socio-political order, whereas this study tries to explore their order-expressing and order-constituting roles. The results of the study are largely three things: First, the right-duty(obligation) conceptual system can compose, as fit to the organic living order unfolded in a generative way, the present and potential demands arising from the whole gamut of social lives of the constituents in a political society, and express the living order in its own way. Second, it can convert social relational orders, characterized as contractual ones, into the conceptual relational order. And third, it can express and convert Western liberal socio-political order system into the conceptual order system of rights and duties(obligations). This study implies two things: one is that with the conceptual system of a right and a duty(obligation), liberal democratic society presents itself, differently from private-vs.-public dichotomy paradigm, as one organically unified area of life, and its socio-political orders as reflection of the enduring living order. The other is that seeing from order-constituting role, the demands from private individual life and the demands from public socio-political orders are in mutually feedback relations in a generative way. And this study shows that the order-system constructed with the concepts of a right and a duty( obligation) has some strong points over socio-political order-system: One of them is that the former, compared with the latter, provides us with a more realistic explanation on the change and generation of socio-political orders. Another is that the former, compared with the latter, provides us with more concrete information concerning the stability level of the existing socio-political orders.
