지역경찰의 초동수사의 효과성에 관한 조사연구 = A Study on the Effectiveness of Initial Investigation by Regional Police Officer

The police is the organization which exercises a power. Compared with general administrative organization, the police has a different character. Specially, after the police arrests the criminal, it must prove one's guilt, and guarantees human rights.
Will it not be able to be sufficient truth and human rights simultaneously? This is the subject and a difficult problem of police. Luckily, the police is recognizing the importance of the scientific investigation and using a scientific technique recently. In the future, the human rights and legal process will be emphasized in the investigation, and the scientific investigation will be in the middle of it. There is a tendency which a scientific evidence and criminal arrest are considered more importantly, but the process of the scientific investigation is started from the early stage of crime. The initial investigation process which is started from crime report is important from all procedures as a whole, and the crime scene is very important. If there is not any evidence in crime scene, criminal investigation is fatal.
The purpose of this study is to research the recognition of the local police officer about the initial investigation and to seek the method of an improvement after observing the present condition and a problem of the initial investigation.
This study focused on the 4 factors which affects on the initial investigation, that is, a human factor, a material factor, a institutional factor and a resident relation factor.
The result of research is following.
Generally, the factors which affect on the initial investigation of the violent crime were professionalism, move equipment and mutual assistance. The professionalism means abilities of body defense, a criminal arrest and evidence collection. The move equipment is the patrolling vehicle and a personal carrying equipment. Also, the mutual assistance mean the cooperation with 119 fire fighting agency, the medical institution and the investigation police.
When observing the initial investigation step by step, the professionalism, communication equipment, institutional use and mutual assistance are meaningful at the first step. While the professionalism had an the most influence, the manpower management factor, carrying equipment factor and the resident factor were not so important. Also, in the process of initial investigation, the local police officer recognized that the first step is the most important.
At the second step, the professionalism, institutional use, mutual assistance and the resident factor are meaningful. Among those, the professionalism factor had an influence, but he manpower management factor, carrying equipment factor and communication equipment factor didn't. Nextly, an influence of institutional management factor and a resident relation factor were low.
Last step, professionalism factor, manpower management factor, carrying equipment factor, communication equipment factor and mutual assistance factor are meaningful. Among those, the professionalism factor had an influence most. On the other hand, the institutional management factor and the resident relation factor had not much meaning.
Therefore, the professionalism, mutual assistance and move equipment are important at the initial investigation, and the first step is the most important.
First, the professionalism means the professionalization of the police officer, and the efficient application of the education-training and manual. Sthal and Staufenberger said that the training and education for the development and a change of police is important. Systematic education and effective manual are needed for the professionalization of the police officer.
The next is mutual assistance. First, a information transmission by the order station(police) is very important . Also, the mutual assistance of the investigation police is important. The mutual assistance with the investigation police is the starting point for the following investigation as well as the end of the initial investigation.
Among material factor, the recognition about carrying equipment factor was relatively low, but the requirement about carrying equipment factor was most. As the material factor, therefore, improvement and reinforcement of the moving equipment are needed.
Next, the resident relation factor means the victim, the witness and the resident. Specially, the cooperation between witness and the resident is needed. Even though the cooperation of the witness and the resident was very important practically, the actual recognition turned out negatively.
Now, the law is not the whole milk water of the specific person any more. The law is for all people. The police must keep the neutrality from politics, control the power, and it must be modest to the citizen.
