The purpose of this study is to investigate the improvement of the system for shortening the project period and promoting more efficient reconstruction projects by securing the transparency and publicity of the maintenance projects in the reconstruction projects implemented in Seoul city. In this study, we analyzed various cases in the field to present the problems and conflict types that occurred in the reconstruction project objectively. We also investigated the causes of the conflicts through questionnaires of the court cases, industry - related articles in order to find solutions.
The reconstruction project, which is implemented based on the procedures prescribed by the Urban and Residential Environment Improvement Act, aims to improve old and poor housing and infrastructure as part of a long-term maintenance project from the designation of the maintenance area to the union dissolution. It will promote the business with collateral.
As a result, various problems and conflicts such as conflicting interests by owners, co-existence with partner companies, and strife of interests have occurred frequently, resulting in irrelevant complaints, accusations by owners, and business delay for a long period of time. It causes a lot of social problems and costs, such as contractors’ bankruptcy due to accrued wages due to accrued service fees and owners’ sky-rocketing cost burden.
The reason why these problems and conflicts occur in the process of business promotion is as follows. First, due to the owners' lack of expertise and understanding of the reconstruction project, the purpose of the reconstruction project is recognized as the only means of speculation for asset growth. Second, the unreasonable application due to the differences in interpretation of administrative departments caused by the frequent changes of laws or procedures and systems. Third, the lack of professionalism of project related parties. Fourth, the lack of practical management and supervision system of public administrative agencies.
The Seoul Metropolitan Government is trying to give publicity and binding power to reconstruction projects through the establishment of regulations related to other reconstruction projects and the implementation of public support system, clean-up system, and e-union system. However, as the system is operated as a means to facilitate the management and supervision of the administrative institution without clearly grasping the process, it does not affect the actual problem-solving.
In order to solve the causes of these problems and conflicts, firstly, it is necessary to establish a professional education system for the improvement of owners' awareness of reconstruction projects and understanding of maintenance projects. Secondly, the interpretation of the law or system of each administrative agency should be consistent. Thirdly, it is necessary to improve and revitalize the system of professional maintenance managers to establish the professionalism of the project related parties, so that work can be promoted systemically. Fourthly, an independent system capable of managing the public administrations effectively in order to control external interference with management and supervision.
The purpose of this study is not only to change the structure of urban and residential environment maintenance law but also to suggest realistic improvement plan through actual cases. In addition, it is necessary to study the detailed improvement plan by subject.
