    이 논문은 근대 혼인법과 로맨스 플롯이 공유하는 감정 승인 구조에 주목하여, 1990년대 한국 퀴어 로맨스의 한 사례를 정동 서사법리학의 관점에서 읽는다. 감정 승인 구조란 어떤 관계와 정동만을 ‘사랑’, ‘가족’ 같은 긍정적 감정으로 승인하고 나머지는 사적·일탈적·병리적인 것으로 밀어내는, 역사·사회적으로 배치된 정동 구조를 가리킨다. 대표적으로 혼인·가족제도는 특정한 이성애적 사랑을 ‘정상적인 사랑’으로 인정하고, 퀴어 관계나 비혼 동거, 친구·커뮤니티 기반의 돌봄을 제도 밖으로 밀어내는 사회·제도적 장치로 작동해 왔다. 1장에서는 <장벽—의례적 죽음—인정—결합>으로 이어지는 로맨스 플롯이 어떻게 이성애 혼인만을 정당한 결말로 구성하며, 감정 승인 구조를 제도(혼인법)와 서사(로맨스 장르)의 두 층위에서 동시에 조직하는지를 정리한다.

    This paper examines a case of 1990s Korean queer romance through the lens of affective narrative jurisprudence, focusing on the shared emotional approval structures between modern marriage law and the romance plot. The term emotional approval structure refers to a historically and socially arranged pattern that approves only certain relationships and affects as positive emotions such as “love” or “family”, while relegating others to the private, deviant, or pathological. Typically, the marriage and family system has functioned as a social and institutional apparatus that recognizes specific heterosexual love as ‘normal love’ while pushing queer relationships, non-marital cohabitation, and friend—or community-based care outside the system.
    Chapter 1 outlines how the romance plot—progressing through barrier, ritual death, recognition, and union—constructs heterosexual marriage as the only legitimate conclusion, simultaneously organizing the structure of affective recognition at two levels: the institutional (marriage law) and the narrative (the romance genre). Chapters 2 and 3 then analyze Kim Moo-kyung’s There Are People Who Look Sad Even When They Smile (1999) and The Autumn of Judas (1999), tracing how male-male queer romance transforms this schema into a barrier—ritual death—circumvention—deferred conclusion. The former establishes a minimal ‘right to survive together’ by constructing a circumventive union—rearranging cohabitation and care instead of engagement and marriage—within the barriers of the family system and heteronormative norms. The latter radically embodies the affect of ‘no future,’ where desire, hatred, and self-destruction circulate, unable to be incorporated into any institutional or narrative future.
    Finally, Chapter 4 intersects this narrative analysis with Article 779 of the Korean Civil Code, which defines the legal scope of family, examining both the necessity and the limitations of reconfiguring legal institutions so that they do not preemptively block existing diverse intimacies and care relationships before catastrophe, rather than presupposing only specific family forms. Literary texts thus serve as an archive of affect that points to queer affective and caring relations eluding the law, while affective narrative jurisprudence is an experiment in translating these pointers into the language of law.
