정보통신기반의 공법적 의의와 과제 = The Meaning and Legal Issues of Information and Telecommunications Infrastructure in Public Law

국문 초록 (Abstract)

정보통신기술의 획기적 발전은 정보통신의 공급을 원활하게 하면서 정보사회의 하부구조를 이루는 기반인 정보통신기반을 형성하게 되었다. 정보통신기반이란 ‘정보의 생산, 활용(수집·가공·저장·처리), 유통(송신·수신)과 관련되는 일련의 활동의 기초가 되는 바탕 또는 토대’라고 정의할 수 있다. 정보통신기반의 유형은 정보통신망, 정보통신기기, 소프트웨어, 데이터베이스, 정보통신표준이라고 할 수 있으며, 이들은 정보통신기반이라는 총체적ㆍ추상적 개념의 구성요소로서 규범적 의미를 부여받는 범위가 된다.
정보통신기반은 공공재적 성격을 지니고 있으며, 국제질서 형성에 따른 적극적 대응을 통한 주권의 확립이라는 대외적 의미와 보편적 정보통신 구현을 통한 국민의 삶의 질 향상이라는 대내적 의미를 지닌다. 이는 모두 국가의 역할과 관계가 불가분의 관계가 있다.
오늘날 정보통신기반의 민간화에 따라 민간의 비대화와 사적 이익의 충돌, 새로운 정보통신의 등장에 따른 정보격차의 심화, 디지털 위험이라는 새로운 위험의 증대 등의 문제점이 나타나고 있으며, 정보사회의 발달에 따라 정보통신기반 환경의 변화도 여러 가지로 이루어지고 있다. 그러한 여러 가지 현상에 대응하기 위하여 정보통신기반에 대한 국가의 책임과 역할을 정립하고 관련된 공법적 과제의 해결을 모색하는 것이 요구된다. 이는 헌법적 가치와도 관련이 되는 문제이며, 바로 그러한 점에서 정보통신기반의 공법적 의의가 있다.

다국어 초록 (Multilingual Abstract)

The development of information and telecommunications technology provide the basis of information society. That is information and telecommunications infrastructure which means the foundation of actions related production, use and transmission of information. It is includes network, device, software, database and standard related information and communications. They are application scope of law for information and telecommunications infrastructure.
Information and telecommunications infrastructure is one of public goods. It has two aspect of response to international order and realization of universal services to utilize information and telecommunications infrastructure. So It is related to sovereignty and service of general interest.
A state has some roles for construction and protection of information and telecommunications infrastructure. That is same in the age of guarantee state in front of privatization and sophistication of information society.
Accordingly, it is necessary to focus on constitutional state responsibility and related laws for Information and telecommunications infrastructure. There are many legal matters of privatization and sophistication of information society and it will make expectation that they are solved. That is related to constitutional values. So Information and telecommunications infrastructure has special meaning and significance in public law.
