In the early stage of rebuilding projects such as housing reconstruction and housing redevelopment, obtaining landowners' consent is very important and difficult. In addition, since effective rebuilding projects need to put an enormous amount of money and specialized human resources by stages, it is difficult for only a rebuilding union itself to settle down these problems in reality.
Under the old law, constructors or consulting companies which are invested by the constructors take charge of obtaining landowners' consent and of initial financing for rebuilding projects in general. However, with constructors' excessive competition for receiving an order and rebuilding unions' lack of expertise a variety of irrationalities and disputes take place in the course of carrying out the project. These problems delay the rebuilding project and impose damage upon union members. Therefore, it is necessary to supplement it systematically.
In this vein, the Urban Living Environment Improvement Act, which went into effect on July 1 2003, reduces the role of a constructor which takes the lead in the rebuilding projects practically into a simple contractor, thus cutting off constructor's entry into the initial stage of the rebuilding projects and legally forbidding mutual investment between constructors and consulting companies.
The Urban Living Environment Improvement Act prescribes the business category of consulting which has not been regulated by laws so far as the rebuilding project consultants and requires them to be registered. If they do not register, they can be punished by criminal penalties. In addition, because the rebuilding project consultants are regarded as public officials like union members, they are legally regulated. However, they became systematized as a base of rebuilding projects. With this provision, the rebuilding project consultants take charge of all the initial affairs of rebuilding projects such as the supplement of union's expertise and financing the projects which have been traditionally carried out by constructors and consulting companies under the old law. Therefore, the rebuilding project consultants are the only experts in the initial stage of the rebuilding projects and actually take the lead in the projects. However, different from the legal expectation, the expertise and law-abiding spirit of the rebuilding project consultants are unsatisfactory in real practice of the project. It is because the system of rebuilding project consultants has been established hastily and has not been equipped with a special certificate system or an educational system and the requirements for their register are very abstract. Above all, the biggest problem of the rebuilding project consultant system is that there is a big gap in initial financing in the early stage of the rebuilding projects. In the conventional rebuilding projects such as housing redevelopment and housing reconstruction, the role of financing has been mainly played by constructors. However, with the enactment of the Urban Living Environment Improvement Act, constructor's entry into the initial stage of the rebuilding projects is cut off and the only way of financing in the early stage of the rebuilding projects is acquired it from the registered capital of the rebuilding project consultants. However, this regal capital of the rebuilding project consultants is insufficient to carry out even a project. This reality is regarded as a problem for the rebuilding project consultant system which must be urgently settled down stably. The rationalization and stable settlement of the rebuilding project consultant system need to improve followings:
First, in order to reinforce the expertise of the rebuilding project consultants, national level specialized education system and qualification system must be introduced.
Second, in order to ensure financing in the early stage of the rebuilding projects, the capital of the rebuilding project consultants must be increased in a practical manner. In addition, a refined advanced country-style financing system with which the rebuilding project can be funded through the security of the project itself must be introduced. If the above two problems are improved, the rebuilding project consultants can recover their status even to the extent that everyone regards them as the leader of the rebuilding projects.
