성매매 : 여성주의 성정치학을 위한 시론

국문 초록 (Abstract)

본 논문은 성매매에 관한 획일적 담론 구조에 대해 제동을 걸면서 다른 개념화의 가능성 탐구를 그 목적으로 한다. 성매매와 연관된 서구 여성운동의 논쟁은 주로 ‘규제주의(regulationist)'와 ‘근절주의(abolitionist)'를 중심으로 이루어져 왔으나, 1980년대 이후 ‘강제(forced)’ 대 ‘자발 (voluntary)’이라는 대립적 개념이 ‘성노동(sex work)'이라는 개념과 맞물리면서 복잡해지는 양상을 띠고 있다. 그러한 논의구도는 여성의 몸과 섹슈얼리티, 성적 정체성과 행위성, 가부장제와 성차별, 자본주의와 노동, 계급관계, 인종차별, 지구화와 국가간 불평등의 문제 등, 다양하고 다층적인 측면에서 성매매 문제를 접근할 수 있는 이론적 토대를 발전시켜왔다.
우리나라 여성주의자들은 성매매에 대한 가부장적인 사회인식을 변화시키고자 노력하면서 성매매가 개인적 윤리의 문제가 아니라 사회구조적인 문제이자 인권문제라는 입장에서 접근해 왔다. 그들은 성매매의 폭력성과 총체적인 사회구조적인 맥락을 드러내면서 성매매 여성들을 피해자로 재구성하고자 노력해 왔다. 그러한 노력은 지난 2004년 3월 23일, 성매매방지법의 ‘성공’적인 국회통과를 추동하였다. 그러나 현재 성매매 담론의 특징은 ‘근절’을 정점으로 한 단일한 시각으로 수렴되고 있다. 여기에는 가부장의 ‘위선적인 근절’논리와 ‘공창’의 논리에 맞서 하나의 전선을 형성해야 한다는 실질적인 명분이 깔려있지만, 문제는 이분법적 선택의 강요로 인해 내부적인 경계가 그어지고 있으며, 다양한 실천의 역사와 여성들의 목소리가 획일화되고 있다는 점이다.
본 고는 그러한 문제의식 하에 일반화와 보편화의 문제, 성적 본질주의의 문제, 지배담론의 재생 산 문제 등 몇 가지 쟁점을 중심으로 여성주의 내 주류 담론과 시각을 고찰하고, 노동 (work)과 성(sex)의 복합구조 속에서 성매매를 다시 볼 것을 제안하였다. 이는 결국 섹슈얼리티와 여성성에 대한 가부장의 전통과 인식에 저항하면서 실질적인 변화를 이끌어 냈던 여성주의 성정치학의 바로 그 지점에서 성매매를 재인식하고, 문화전반에 겹겹이 얽혀 있는 성애화, 성별화된 노동구조에 대한 문제제기의 연장선상에서 성매매를 사고하는 것과 맥을 같이 한다.

다국어 초록 (Multilingual Abstract)

The purpose of this paper is to explore the possibility of ‘alternative' theorization on prostitution, while tackling the current hegemonic discours on it. Prostitution around which women's bodies, sexuality, gender discrimination, class, and race are interlocked has been a contentious issue for feminists. Two competing views on prostitution- ‘regulationist' and ‘abolitionist'- had prevailed among Western feminists until the ideas about ‘forced' and ‘voluntary' prostitution, female international migration, and sex workers' rights arrived on the public scene in the 1980s. Contemporary Western feminist views, including those of activists and scholars, on prostitution regarding human trafficking are split along ideological lines, depending on their perspectives on the body, sexuality, work, and feminist politics. The crucial difference of contemporary opinion is the relevant question of whether a person can choose prostitution as a profession or whether women are always forced to be prostitutes and whether prostitution can be considered work or not.
On the other hand, the perspectives of Korean feminists can merge into one perspective, ‘abolitionism.’ Korean feminist NGOs have some significant success in bringing prostitution into public consciousness, while challenging patriarchal conception of prostitution and shifting approaches from ‘personal' to ‘structural, systematical, and social' problems. What I would problematize, however, is that different perspectives on prostitution have not been permitted among feminists and feminist NGOs, other than the idea of ‘forced' prostitution and the abolitionist view. I do not mean that there is anything inherently wrong with the NGO's perspectives or demean their efforts to ‘help' or ‘rescue' ‘victimized' ‘prostituted' ‘poor' women. There is nothing wrong with favoring one idea over others nor focusing on certain issues. The process may be necessary to make some tasks more manageable. It has also been helpful for the prostitutes to get public recognition from a human rights perspective. However, it is ‘problematic,' when alternative perspectives are systematically blocked, ignored, or emotionally resisted by institutionalized knowledge and settled discourse. When there is an official frame or ‘master narrative' enveloping it, varied ‘causes' of the issue and other ‘voices' are muted, isolated, separated, and/or simplified with no room for variation, overlap, or considerations of different social contexts. That tendency leads to the problems of universalism, essentialism, and reproduction of patriarchal ideas of sexuality and gender which feminist politics have struggled against.
Therefore, this paper argues that the combined idea of sex and work are required, because prostitutes' experiences are related to other sexualized and gendered income-generating activities that women perform in the whole patriarchal capitalistic societies. I am convinced that this kind of thinking will permit a complex understanding of prostitution without losing the insight and accomplishment of feminist sexual politics.
