An Analysis on the Process of Making the Law of Foreigners Educational InstituteKim, Yongill(Korea Maritime University)Now we are entangled with Korea-U.S. Free Trade Agreement, which contains the issue of ‘educational market’ opening. On the one side, there are many people who support the opening of ‘educational market’. For it will raise the standard of our educational services via bench-marking the superior sector of the two nations. On the other side, there are many people who have the opposite opinions. They often argue that education is not for the 'market' and the opening of it will undermine the bases of our public educational system.In this vein, there has been a hot issue called ‘the self-liberalization measure' in Korea. So in this article the author focuses on the law making process of the Foreigners' Educational Institute(FEI) which is seen as a typical example of ‘the self-liberalization measure'. The data mainly come from the minutes of The National Assembly of the Republic of Korea. Overall, the author argues that unfortunately the FEI law is compelled by the economic Ministries for increasing foreigners' investments. For this reason, it is emphasized that strengthening educational values and having a prior consultation among Ministries are very important in education-related law making.
