아동복지법상 자립지원 대상자의 복지향상을 위한 법제 고찰 = A Study on the Legislation for Welfare Improvement in Persons Eligible for Self-reliance Support in Light of Child Welfare Law

국문초록

사회적으로 자립지원 대상자인 아동의 보호가 종료되면 아동은 해당 보호시설에서 퇴소하게 되는데. 이로 인한 사회·경제적 어려움, 심리적 불안감, 주거문제 등을 비롯한 다양한 문제에 봉착하게 되고 이러한 문제를 자립지원 대상자가 직접 해결해야 한다는 부담감과 두려움을 겪게 된다.
이에 2024년 2월 6일「아동복지법」일부개정을 통해 아동의 재보호조치를 규정하였는데 이는 자립지원이 필요한 아동의 범위를 대통령령에서 법률로 상향하고, 18세에 달하기 전에 보호조치가 종료되거나 해당 시설을 퇴소한 사람으로서 보건복지부장관이 자립지원이 필요하다고 인정한 사람도 자립지원 대상자에 포함하도록 하는 등 현행 제도의 운영상 나타난 일부 미비점을 법률 개정을 통해 개선ㆍ보완하였다. 이는 자립지원 대상자의 범위를 확대함으로서 자립지원 대상자의 복지향상을 기하고자 하였다.
하지만 자립지원 대상자에 대한 다양한 법·제도적 개선책이 나오고 있지만 복지에 있어실효성 문제가 여전히 제기되고 있다.
「아동복지법」개정에 따라 자립지원 대상자의 연령과 재보호조치에 대한 근거는 마련이 되었으나 이를 계속적으로 「아동복지법」개정을 통해 복지향상을 하기에는 한계가 존재하기 때문에 여러 지방자치단체의 자치법규로 제정되어 있는 자립준비 청년의 복지향상을 위한 조례가 자립지원 대상자의 복지향상을 위한 특별법으로 제정되어 자립지원 대상자의 복지에 있어 근거법이 되어야 한다.
또한 「아동복지법」 제38조의2에 의한 자립지원 실태조사에 있어 자립지원 대상자의 사각지대 발굴을 위한 실태조사도 함께 이루어져야 하며 실태조사를 3년마다 실시하는 것이 아닌 자립지원은 5년을 기준으로 하기 때문에 매년 실시하고 이를 자립지원 계획을 수립하는데 있어 실태조사 결과를 반영하여야 할 것이다.
그리고 「아동복지법」제19조에 의한 아동의 후견인 선임 청구에 있어 아동복지시설에 입소 중인 보호대상자 아동에 대하여 「보호시설에 있는 미성년자의 후견직무에 관한 법률」을 적용에 있어 보호시설의 퇴소 후의 자립지원 대상자의 후견직무에 대한 후견인의 선임 범위를 확대할 필요가 있다.
이러한 법제 개선을 통해 자립지원 대상자에게 실효성 있는 지원함으로서 그들이 사회에 올바르게 적응하게 할 수 있을 것이다.

Abstract

The child comes to be discharged from the relevant protective facilities given being terminated the protection of a child eligible for social self-reliance support. This leads to being confronted with various problems including social and economic difficulties, psychological anxiety and housing problems. Pressure and fear get into being experienced as saying that a person eligible for social self-reliance support should directly solve this problem.
Accordingly, the child re-protection measure was prescribed through the partial amendment in 「Child Welfare Law」on February 6 of 2024. This resulted in having improved and supplemented some loopholes, which were shown in the operation of the current system, through the law revision such as raising the scope of children in need of self-reliance support from a presidential decree to a law and as including even those who have been deemed necessary by the Minister of Health and Welfare to be eligible for self-reliance support as a person who was finished the protective measures or left the corresponding facility before reaching the age of 18. This was aimed to contribute to enhancing the welfare in persons eligible for social self-reliance support by extending the scope of people eligible for self-reliance support.
A variety of legal and institutional improvement measures are emerging with regard to those eligible for self-reliance support. But the effectiveness problem about welfare is still being brought up.
The basis for the age and re-protection measures as to those eligible for self-reliance support has been established according to the revision of 「Child Welfare Law」. Nevertheless, there is a limit to promoting welfare through continuing to amend 「Child Welfare Law」. Hence, the ordinance for the improvement in the welfare of youth preparing for independent living, which is enacted as the local statute of several local governments, must become the applicable Act in the welfare of persons eligible for self-reliance support, by being enacted as a special law to upgrade the welfare of persons eligible for self-reliance support.
Furthermore, there is a need to discover blind spots and to investigate the real condition of those eligible for self-reliance support in the fact-finding survey on self-reliance support under Article 38-2 of 「Child Welfare Law」. A fact-finding survey shall be conducted annually and reflected in the establishment of a self-reliance support plan.
Moreover, In counseling for those eligible for self-reliance support, regular training of dedicated professionals and expansion of qualified professionals should be made to have expertise in the field.
lastly, in a request for the appointment of a child's guardian in accordance with Article 19 of「Child Welfare Law」, there is necessity of expanding the scope of appointment of guardians for guardianship duties pertinent to persons eligible for self-reliance support after the release of the protective facilities, in terms of applying 「Act on the guardianship duties for minors in the protective facilities」to children under protection in the child welfare facilities.
This legislative improvement leads to supporting effectively those eligible for self-reliance support, resulting in being likely capable of allowing them to adapt properly to society.
