The Supreme Court held that the responsibility of a sports facility(so-called a “health club”) toward its members under Article 27, Section 2 of the Sports Facilities Act shall not be succeeded by a third party who purchases through a private contract the real property where a sports facility was established if a public auction commences for such real property under a trust agreement and no successful bidder was found after several rounds.(Case No. 2012 da 4817 decided on April 26, 2012) Recently, the number of golf courses going bankrupt due to financial difficulties in the industry has significantly increased, and whether the substance of the above holding of the Court can be equally applied to the public auction of all sports facilities as trust property, including golf courses has been the subject of much controversy. There are two different views on how to interpret the Sports Facilities Act in relation to the public auction of trust property. A minority view denies the succession of responsibilities for the members while the majority view accepts such succession. In light of all factors involved, including the legislative intent for the Sports Facilities Act, the need to ensure the contribution of sports facility members and their legal status, the Constitutional Court's view on constitutionality, utility of trust system for public interest, general purposes of trust, and a potential evasion of the application of the Sports Facilities Act, I believe Article 27, Section 2 of the Sports Facilities Act shall also apply to the public auction of trust property. I hope active in-depth discussions on the assumption of membership in relation to the public auction of sports facilities in trust will unfold in future and further anticipate that the Court will set a new precedent in the near future that will clear once and for all confusion in the transaction area.
