혁신클러스터 법제 확대에 따른 법리적 충돌과 행정 비효율에 관한 연구

국문 초록 (Abstract)

최근 정부 정책으로 혁신클러스터 법제가 강조되고 있으나, 법리적·행정적 검토 미비에 따른 비효율 등이 우려된다. 본 연구는 선별된 기준으로 동일 조건에서 비교 가능한 5개의 혁신클러스터와 관련 법률을 비교 분석하였다. 입법 과정에서는 기존 클러스터 모델에 혁신 기능을 추가하는 식의 방법으로 일반 클러스터의 혁신클러스터로의 수렴과 이로 인한 모델 간 차별성 약화 현상을 확인할 수 있었다. 지정 현황 분석을 통해서는 특히 동일 필지(단)에 2개 이상 혁신클러스터가 중복 지정되어 있는 현황에 집중하여 특례 및 제한조항 적용 시 불명확성과 조항 간 상충 가능성을 도출하였다. 마지막으로는 각 법률 상 특례 및 제한 조항을 상호 비교하여 타법 적용 여부의 불확실성, 타법 완화 조항 허용에 따른 특례의 과중 적용 및 당초 법률 목적성의 위배, 관련 이해관계자들의 행정적 불편함을 지적하였다. 분석 결과를 토대로 입법 과정에서의 무분별한 모델 신설 및 기능 추가 방지, 통합적 클러스터 조회 시스템 구축, 중복 지정 필지에 대한 법률 우선순위 확정 등의 정책 정비 방향성을 제시하였다.

In recent government policies, there has been an emphasis on innovation cluster legislation; however, concerns arise due to insufficient legal and administrative reviews, leading to potential inefficiencies. This study conducted a comparative analysis of five selected innovation clusters and their related laws based on predefined criteria for comparable conditions. The legislative process revealed a tendency to converge general clusters into innovation clusters by incorporating innovative functions into existing cluster models, resulting in a potential weakening of distinctiveness among models. Through an analysis of the current designation status, particular attention was given to situations where two or more innovation clusters were redundantly designated on the same land parcel, uncovering ambiguities and potential conflicts in the application of exceptions and restrictions. Finally, a comparison of special provisions and restrictive clauses in each law highlighted uncertainties in the application of other laws, the potential for excessive application of exceptions due to lenient provisions, and violations of the original legislative intent. Administrative inconveniences for relevant stakeholders were also identified. Based on the analysis results, recommendations were made for policy adjustments in the legislative process, including preventing indiscriminate establishment of new models and addition of functions, establishing an integrated cluster inquiry system, and determining legal priorities for overlapping designated parcels. These suggestions aim to address the uncertainties and challenges encountered in the legislative process.
