    기후 변화 대응과 지속 가능한 에너지 전환을 위한 정책이 전 세계적으로 강화되는 가운데, 해상풍력발전은 높은 발전 효율과 탈탄소화 기여도에서 중요한 역할을 담당하고 있다. 한국은 2050 탄소중립 목표 실현을 위해 해상풍력발전을 확대하는 정책을 추진하고 있으나, 관련 법·제도의 미비와 복잡한 인허가 절차, 지역사회의 낮은 수용성으로 인해 실질적인 보급 확대가 지연되고 있다. 본 연구는 에너지 정의(Energy Justice)의 관점에서 해상풍력발전과 관련된 법적 문제를 검토하고, 이를 개선하기 위한 입법적 방안을 제시하는 것을 목적으로 한다. 에너지 정의는단순한 에너지 공급 확대를 넘어 경제적, 환경적, 사회적 형평성을 고려한 공정한시스템을 구축하는 것을 의미한다. 본 연구는 에너지 정의를 구성하는 세 가지 핵심 요소인 분배적 정의(Distributive Justice), 절차적 정의(Procedural Justice), 인정적 정의(Recognition Justice)를 중심으로 한국 해상풍력발전 법제의 한계를 분석하였다. 이를 위해 한국의 관련 법령을 검토하고, 덴마크, 독일, 영국, 프랑스 등 해외주요국의 입법 사례를 비교하여 개선 방향을 도출하였다. 첫째, 해상풍력발전의 경제적 혜택과 부담이 특정 계층이나 지역에 집중되는 현상이 발생하고 있으며, 이로인해 분배적 정의가 실현되지 못하고 있다. 민간 주도의 입지 선정 과정에서 사업자의 이익이 최우선시되면서, 지역 주민들은 환경적 부담을 떠안으면서도 경제적혜택을 충분히 누리지 못하는 문제가 발생한다. 이에 대한 해결책으로, 국가가 주도적으로 해상풍력입지를 지정하도록 하고 일정 비율의 발전소 지분을 지역 주민과 지방정부가 소유할 수 있도록 하는 법적 제도 도입이 필요하다. 덴마크의 국가주도입지선정, 지역 소유권 할당 규정 및 독일의 협동조합 모델은 해상풍력입지의공정한 지정과 지역 주민의 경제적 참여를 보장하는 대표적인 사례로, 한국에서도이를 참고하여 합리적인 입지 선정 및 발전 이익이 지역사회에 환원될 수 있도록법적 기반을 마련할 필요가 있다. 둘째, 해상풍력발전의 추진 과정에서 인허가 절차의 복잡성과 불투명성이 절차적 정의를 저해하는 주요 원인으로 작용하고 있다.
    한국의 경우, 발전사업 허가, 공유수면 점·사용허가, 환경영향평가 등 여러 개별 절차가 존재하며, 다수의 부처가 이를 각각 관리함으로써 행정적 부담이 가중되고 있다. 이는 사업자뿐만 아니라 지역사회에도 불확실성을 초래하며, 장기적인 지연 문제를 야기한다. 본 연구는 이를 해결하기 위해 덴마크의 ‘원스톱 샵(One-Stop Shop)’ 시스템을 도입하는 방안을 제안하며, 인허가 절차의 일원화를 통해 효율성을 높이고 행정적 일관성을 확보할 필요성을 강조한다. 셋째, 해상풍력발전의 추진 과정에서 지역 주민 및 어업 공동체의 의견이 충분히 반영되지 않고 있으며, 이로 인해사회적 갈등이 빈번하게 발생하고 있다. 인정적 정의의 관점에서, 에너지 정책이특정 계층이나 지역사회를 소외시키지 않도록 보장하는 것이 중요하나, 한국의 법· 제도는 지역 공동체의 의견 수렴을 형식적으로 진행하는 경우가 많다. 영국의Statement of Community Consultation (SoCC) 제도는 대규모 인프라 프로젝트, 특히 해상풍력 프로젝트에서 지역사회 협의를 투명하게 관리하고 기록하는 핵심 도구다.     As policies to address climate change and promote sustainable energy transitions are being strengthened globally, offshore wind power plays a crucial role due to its high efficiency and contribution to decarbonization. South Korea has been implementing policies to expand offshore wind power to achieve its 2050 carbon neutrality target. However, the lack of a comprehensive legal framework, complex permitting procedures, and low public acceptance have delayed its practical deployment. This study examines legal issues related to offshore wind power from the perspective of energy justice and proposes legislative measures for improvement.
    Energy justice goes beyond merely expanding energy supply; it aims to establish a fair system that considers economic, environmental, and social equity. This study analyzes the limitations of South Korea’s offshore wind power legal framework based on the three core components of energy justice: distributive justice, procedural justice, and recognition justice. To derive improvement measures, South Korea’s legal framework is reviewed and compared with legislative cases from major countries, including Denmark, the United Kingdom, France, and Germany. First, the economic benefits and burdens of offshore wind power development are concentrated in specific groups or regions, preventing the realization of distributive justice. In the private-led site selection process, project developers prioritize their own interests, resulting in local residents bearing the environmental burdens without receiving sufficient economic benefits. To address this issue, it is necessary to establish a legal framework that enables the government to designate offshore wind power sites and mandates a certain percentage of power plant shares to be owned by local residents and municipal governments. Denmark’s state-led site selection, local ownership allocation regulation, and Germany’s cooperative model serve as representative examples that ensure fair site designation and economic participation of local communities. South Korea should refer to these cases to establish a legal foundation that allows for rational site selection and the redistribution of development profits to local communities. Second, the complexity and lack of transparency in the permitting process act as major barriers to procedural justice in offshore wind development. In South Korea, multiple separate procedures— including power generation business permits, licenses for the use of public waters, and environmental impact assessments—exist, with various government agencies managing them independently, thereby increasing administrative burdens. This creates uncertainty not only for developers but also for local communities, leading to long-term project delays. To resolve this issue, this study proposes the introduction of Denmark’s “One-Stop Shop” system, which consolidates the permitting process to improve efficiency and ensure administrative consistency. Third, the views of local residents and fishing communities are not sufficiently incorporated into the offshore wind development process, frequently leading to social conflicts. From the perspective of recognition justice, energy policies must ensure that no particular group or community is excluded from decision-making. However, in South Korea, public consultation procedures are often conducted in a formalistic manner rather than ensuring meaningful participation. The Statement of Community Consultation (SoCC) in the United Kingdom is a key tool for transparently managing and documenting community engagement in large-scale infrastructure projects, particularly offshore wind projects.
