사이버 공간과 여성문제 : 정부역할에 관한 논의 = Cyberspace and Women's Problems

국문 초록 (Abstract)

이 연구는 사이버공간에서 이루어지고 있는 성폭력적인 여성문제들을 이론적으로 고찰하고 본질을 분석함으로써 그 해결방안을 모색하고자 한다. 사이버공간에서의 성폭력은 공공재적 필요성을 포함하는 명백한 해결문제로 사이버 성희롱, 사이버 명예훼손, 사이버 스토킹, 음란물 전송 및 게시 등으로 나타나고 있다. 정부는 사이버공간에서 성폭력적인 내용으로 여성들에게 접근되는 정보의 유형에 따라 정부역할의 차별화를 꾀할 수 있다. 정부는 규제적 견지에서 금지 처벌적 법규를 입법화할 수 있으며, 지원적 입장에서 신고센터의 운영이나 교육, 상담, 등급사정 등의 사전정보제공 등의 자율적 운영에 관한 보다 구체적인 대 응 프로그램을 전개할 수 있다. 이러한 정부의 규제적 역할과 지원적 역할의 정도에 따라 사이버공간에서의 정부역할은 자유방임적 방관자, 입법을 강화하는 규칙제정자, 가부장적 규제자 및 집행자, 통제된 자율속의 조정자로써 다양하게 제안될 수 있다. 바람직한 정부의 역할은 자유방임으로부터 입법주의를 거쳐 가부장적관리를 지나 통제된 자율로 이동하는 것이 바람직하다고 사료된다.

다국어 초록 (Multilingual Abstract)

The purpose of this article is to look for the way to solve women's problems by researching the problems related to sexual violence taking place in cyberspace and analyzing the nature of them. Sexual violence in cyberspace has shown in terms of cyber-harassment cyber-defamation, cyber-stoking, notice of pornographic material. Government can pursue the differentiation of its role according to the type of information, which has sexual-violent contents and is provided to women in cyberspace. Government can legalize the prohibitive and punishing laws and regulations from the restricted view. It also can develop the more detailed counter-program on operation of report center or autonomous operation in providing information in advance on education, consultation, labelling and filtering from the supporting perspective. Such government roles can be proposed with diversity as non-interferent spectator, rule maker enhancing legislation, patriarchal regulator and executor, coordinator in controlled autonomy according to the level of controlling role and supporting role.
In my view, it is desirable that the government role moves from strict noninterference to controlled autonomy passing a legislator and patriarchal management.
