피해자 복지를 위한 신제도론에 관한 연구

국문 초록 (Abstract)

환경오염, 교통사고, 화재, 자연재해, 특히 범죄로부터 피해자 집단은 점차 다양화되고 그 규모 또한 커지고 있다. 피해자들의 생명과 재산을 보호하고 정서적 안정을 도모하여 사회안전과 사회통합을 구현하는 것이 어느 때보다 적실하다 할 것이다. 범죄발생시 피의자와 피해자 보호를 위한 기존 메커니즘인 구제도론이 무엇인지를 파악하고 어떤 문제점이 있는지를 가늠해보고자 한다. 그리고 이러한 구제도론이 갖고 있는 문제점을 보완하거나 극복하기 위해 신공공관리론에 서 사회현상을 분석하고 사회문제해결을 위한 지식체계를 제공해 주는 것으로 기대되고 있는 신제도론에 관한 검토를 하고자 한다. 피해자에 대한 보다 체계적이고 적합한 보호를 위한 지식체계를 정립하려는 연구목적의 실현을 위해 먼저 제도의 형성과 변화에 대한 일반이론을 파악하고, 그 다음으로 구제도론의 내용과 특성 및 그 한계를 분석했으며, 마지막으로 신제도론이 무엇이고 어떤 분파이 론이 있으며 각 이론을 문제해결에 어떤 메시지를 주고 있는 지를 검토하였으며, 최근에는 다시 어떤 변화양태를 지니는 지를 파악하였다.

다국어 초록 (Multilingual Abstract)

The purpose of this study is to arrange a sum of knowledge grounds for the victim's protection and welfare. On that account, The main attempt of this study is as following : First attempt of this article is to grasp general formation and change of institution. Second attempt is to verify differences between the traditional institutionalism and the new institutionalism by it's founding background, the concept of institution, the correlation of institution and human behavior, the perspective of institution's formation and change, and it's value in use. Third effort is to discriminate theoretical stances among the three variantes of the new institutionalism, what is called historical institutionalism rational choice institutionalism sociological institutionalism by it's founding background, the concept of institution, the correlation of institution and human behavior, the perspective of institution's formation and change, it's utilities as each domain, the durability of institution and a path-dependency. As a consequence, the three variantess of the new institutionalism is useful as it's case, context, time, interest equilibrium point.
