지상파방송 규제에 관한 비판적 고찰 = 방송법상 공적 책무와 재원 관련 규정을 중심으로

국문 초록 (Abstract)

지상파방송은 유료방송과 달리 특수성을 가지고 있다. 이를 공익성이라고 부르기도 하고 공적 책무라고 하기도 한다. 방송통신융합과 함께 2기 방송통신위원회가 출범했지만 지상파방송의 정책 부재는 여전하다. 본 논문에서는 변화하는 방송통신 환경에서 지상파방송의 공적 책무와 재원 정책을 비판적으로 검토한다. 이에 따라 우선 방송법상 공적 책무 조항, 재허가/평가제, 편성규제, 내용규제, 미디어 접근권을 살펴보았다. 지상파방송의 재원 관련 조항으로는 협찬규제, 광고규제, 외주정책, 재송신정책의 문제점을 검토하였다. 이러한 논의를 통해 본 논문은 우리사회에서 지상파방송의 유효성이 인정된다면 지상파방송 정책에서 공적 책무와 관련한 규제인지, 재원을 취약하게 하는 규제인지, 아니면 공적 책무나 재원확보 모두 무관한 규제인지 나누어 판단하고 정비할 것을 제안하였다. 구체적인 지상파방송 규제 개선방안으로는 공적 책무 조항을 체계적이고 구체화할 것, 일부 광고규제를 포함하여 공적 책무와 무관하게 재원을 취약하게 하는 규제를 폐지할 것, 방송시간 제한 등 공적 책무에 역행하는 제도를 개선할 것 등이다.

다국어 초록 (Multilingual Abstract)

Broadcasting has unique characteristics unlike cable/satellite TV. It is called public interest or public responsibility. Domestically, the second period Korea Communications Commission appeared with convergence at the same time. Still, broadcasting is isolated from policies. In this article, public responsibility and revenue resource policy are reviewed critically in changing communication environments. So, first of all, public responsibilities, license, program evaluation, program quota system, content regulation, and media access on broadcasting Act are reviewed. Regarding broadcasting resource provisions, problems such as sponsorship regulation, advertising regulation, independent broadcasters policy, and retransmission policy are reviewed. If the effectiveness of broadcasting exists in our society, this article suggests classifying it if the restrictions are related to public responsibility, revenue resource, or regardless restrictions and then organizing them. As detailed policy improvements, public tasks should be specified and arranged systematically. Certain restrictions which weaken resources regardless of public responsibilities centered in restrictions on some commercials should be abolished. System which runs counter to public responsibilities like broadcasting time limit should be improved.
