국문 초록 (Abstract)

본 연구는 현실적으로 우리 사회에서 통합의 대상이자 하나의 시민으로 존재하는 외국인의 가족의 문제 특히, 다문화주의를 중심으로 한 다문화가족에 대한 법과 정책, 제도적 문제와 그 방향을 고찰하고자 한다. 이를 위해서는 많은 외국의 사례가 필요할 것이나, 민족국가를 강조하는 우리의 실정을 감안하여, 우리와 마찬가지로 민족의 개념을 강조하는 일본의 현실적인 경우, 법적 지원 측면에 대한 내용 등을 비교법적으로 분석해 보아 입법정책적인 방향을 제시하고자 한다.
일본은 다른 국가들의 적극적 입법행위와는 다른 다문화공생 정책을 추진하고 있으며, 이 정책이 뚜렷한 이념을 제시하거나 제도적 변화를 꾀하기 보다는 지역사회에서 외국인 주민이나 일본인 주민들이 실제 겪는 생활상의 문제를 해결하면서 자발적으로 공존의 질서를 형성해가고 있다는 것은 참고할 내용이다.
이러한 내용을 바탕으로 본다면, 다문화가족의 통합을 위한 법제도적 방향은 첫째, 인간의 존엄과 가치의 확대를 통하여 헌법상 권리의 범위를 확대되어야 할 것이다. 둘째, 외국인의 권리에 대한 측면보다는 우리사회 구성원에 대한 소수자의 보호측면을 고려하여야 할 것이며, 이를 위해서는 사회구성원 모두가 동화가 아닌 통합의 주체가 되어야 할 것이다.
셋째, 일본이 시민단체가 중심이 되어 발전해 왔듯이 정부의 적극적 지원과 시민들이 참여할 수 있는 정책과 법이 제정되어야 할 것이다.
결론적으로 다문화는 민족, 국민국가의 문제와 관련하여 인간의 권리의 측면에서 논의될 필요가 있을 것이다.

다국어 초록 (Multilingual Abstract)

The research have which exists actually from our society and we make in the integrated object the family of the foreigner who exists with the same citizen about multi-culture family and multiculturalism about law and policy, institutional problem and the direction under investigating. For an investigation from the many foreign nation is necessary, to consider our actual condition which the nation state, the case which Japan emphasizes the concept of the nation with the same actual is. So that tries to analyze contents comparison method about the legal support.
Japan have with a multiculturalism symbiotic policy differently, active legislation act of the other nations which this policy present a clear ideology and attempting a institutional change, see from the foreigner residents or the Japanese residents fact to solve the life problem which undergoes, take form the effort of coexistence voluntarily.
To lead the laws direction for the integration of the multi-culture family, first the human being dignity and magnification of value must be magnified the scope of constitutional as a matter of right. Second, about right of the foreigner must become the integrated subject where is not the fairy tale must consider the decimal voluntary protective side about our social member, respects this from the social member means. Three, Japan the civil society is center and means development with the policy and the law, the active support and the citizens and government will be able to participate must be support. Conclusively, the multiculturalism will relate with the problem of the nation state and ethnic group citizen and will have the necessity which will be discussed from the side of right of the human being.
