유럽의 지적제도 비교·분석을 통한 한국형 지적제도 모형개발 = Korean Cadastral System Model through a comparative analysis ofCadastral System in Europe

국문 초록 (Abstract)

독일,네덜란드 등 선진 국가들은 끊임없이 지적제도를 개편해오고 있다. 공간통신정보기술의 발달에 따른 여러 공간정보가 국가공간정보데이터인프라를 기반으로 서로 정보를 공유하고 통합하는데 지적정보가 매우 중요한 역할을 하기 때문이다.
본 연구는 한국과 유럽의 지적제도에 관한 실태를 비교·분석하여 그 결과를 토대로 국민의 재산권을 안전하게 보호하고, 좁은 국토를 효율적으로 등록·관리하며, 각종 토지정책을 수행하는데 필요한 토지정보를 신속 정확하게 제공할 수 있는 현대적인 다목적 지적제도의 구축을 위한 대안을 모색하려는데 목적 이 있다.
연구의 목적을 효율적으로 달성하기 위하여 우리나라와 유럽 5개국(독일·프랑스·네덜란드·덴마크·스웨덴)의 지적제도의 개요, 지적행정조직, 법률체계, 토지등록 및 관리, 지적 분야의 이슈 등을 비교·분석해 한국형 지적제도에 맞는 모형을 제시하였으며 법률적 ,행정적, 제도적, 기술적 모형으로 구분해 연구 하였다.
연구의 결과로서 우리나라 지적제도는 적극적 등록주의를 채택하고 있으나, 토지 등록사항의 책임은 소극적으로 보장하고 있어 앞으로 토지등록을 추진하는데 있어서는 토렌스 시스템을 받아들여 정확도와 공신력을 바탕으로 적극적 등록주의를 강화하고 물리적· 권리 적 사항을 국가가 책임지는 실질적 심사주의를 도입해야한다. 부동산의 표시와 권리에 대한 내용을 서로 다른 기관에서 동일하게 등록·공시하는 것은 중복적인 절차의 이행과 비용이 증가되는 문제가 있어 등기와 지적을 통합 일원화해서 효과적으로 이행할 수 있는 토지 청 이라는 부서를 신설해야한다.
