마르실리우스 파도바의 정치철학에 드러난 권력과 평화 = Power and Peace in Marsilius of Padua's Political Philosophy

This paper aims to the continuity between late medieval and early modern thought in the area of political philosophy by focusing on Marsilius of Padua who was a late-Medieval Italian scholar, deeply involved in the politics of his times. His work, Defensor pacis is one of the most original treatises on political theory produced during the Middle Ages. In the Defensor pacis, he set out to refute the doctrine of papal fullness of power and, in particular, to prove that the pope is not the source of government power.
I wish to argue that Marsilius significantly influenced the modern idea of the state. For this reason, he might be considered a forerunner of the Protestant Reformation and an architect both of the Machiavellian state and of modern democracy. Furthermore, it is my contention that Marsilius is the first exponent of the doctrine of sovereignty later put forward by Hobbes and many others.

국문 초록 (Abstract)

14세기 이탈리아 파도바 출신의 마르실리우스는 서구 정치철학사에 이정표가 될 만한 『평화의 수호자』 라는 그의 작품에서 중세에 속한 것이라고 보기 힘든 국가와 입법자 개념을 제안한다. 그는 사제들이 영적인 일에서조차 시민의 공동체 혹은 시민의 권력을 위임받은 세속의 통치자에게 복종해야 한다고 주장한다. 필자는 마르실리우스의 세속적인 국가개념과 입법권 개념을 분석함으로써 정치철학에서 중세를 근대와 단절된 시기라고 보는 해석에 이의를 제기하고자 한다.
『평화의 수호자』 의 구조는 권력비판의 형식이다. 그 과정은 교황의 '전권'(全權) 개념을 비판하는 것에서 출발하여 교황주권론을 부정하고 시민주권론을 도출하는 형식으로 이루어진다. 이것은 마르실리우스의 시민주권론이라는 정치철학의 이면에 권력비판이 자리하고 있음을 보여준다. 따라서 권력개념을 분석해보면 그가 갖고 있었던 국가개념과 입법자 개념의 특징이 분명히 발견될 것이다.
