The United States has long lacked a comprehensive federal privacy statute comparable to the European Union’s General Data Protection Regulation (GDPR). Instead, U.S. privacy law has developed through sector-specific federal statutes and comprehensive state privacy laws, creating regulatory fragmentation and increasing demands for federal legislation. The American Privacy Rights Act of 2024 (APRA) represented a significant attempt to establish a comprehensive federal framework by providing rights of access, correction, deletion, and portability, regulating sensitive data and data brokers, imposing data minimization and privacy and security obligations, and establishing federal and state enforcement mechanisms and a private right of action. Although APRA ultimately failed to become law, its legislative development reveals important structural limitations and challenges facing U.S. federal privacy legislation.
First, APRA demonstrates the tension between national uniformity and state regulatory autonomy. Federal preemption may reduce compliance costs and establish common national standards, but excessive preemption can eliminate stronger state protections and weaken the states’ role as regulatory laboratories. Future federal legislation should therefore adopt a federal-floor model, establishing minimum national privacy protections while preserving states’ authority to enact stronger safeguards.
Second, APRA exposes the limitations of an individual-control model of privacy. Access, deletion, portability, and opt-out rights are essential, but individual rights alone cannot adequately address the collective effects of data aggregation, profiling, and algorithmic processing. Data-sharing externalities may generate algorithmic inequality and other population-level harms that cannot be effectively addressed through individual consent or opt-out mechanisms.
Third, APRA’s loyalty-program exception illustrates the relationship between privacy and economic inequality. Allowing businesses to provide different prices or benefits in connection with voluntary loyalty programs may create a “pay-for-privacy” structure in which economically vulnerable consumers are more likely to exchange privacy for discounts or other benefits. Such practices may contribute to algorithmic price discrimination and transform privacy protection into an economically stratified commodity.
Fourth, APRA highlights the need to integrate privacy protection, civil rights, and algorithmic accountability. In an algorithmic economy, the collection and use of personal data increasingly influence decisions concerning prices, credit, insurance, employment, and other areas of social and economic life. Privacy regulation must therefore address not only individual control over information but also discriminatory effects, collective harms, and structural information asymmetries.
This Article argues that future U.S. federal privacy legislation should combine a federal floor of protection with meaningful state autonomy; strengthen substantive data minimization and purpose limitation; require opt-in protections for high-risk data processing; and incorporate algorithmic impact assessments and anti-discrimination safeguards. It further proposes a differentiated enforcement framework that combines administrative enforcement by federal and state authorities with a carefully structured private right of action and enhanced remedies for serious, intentional, or repeated violations.
Ultimately, the experience of APRA demonstrates that comprehensive federal privacy legislation should not be understood merely as an effort to create uniform individual privacy rights. Modern data regulation must also address collective data externalities, algorithmic discrimination, economic inequality, and structural information asymmetries. The future of U.S. federal privacy law therefore lies in developing a broader data-governance framework that integrates privacy, consumer protection, c...
