공공지원민간임대주택의 법률상 쟁점 = A Study on the Legal Issues in the Public Support Private Rental Housing

This study is purposed to prospect the future of the public support private rental housing in the special act on private rental housing. Public support private rental housing is introduced as rental housing policy as the law was revised in January 2018. The purpose of special act on private rental housing is to promote the supply of private rental housing and to ensure housing stability for people, by prescribing matters necessary to construct, supply, and manage private rental housing and to foster private housing rental business entities. The State shall supply public rental houses for classes in need of housing support, such as the low-income bracket. The State shall provide support to facilitate the supply of private rental houses.
The people have the right to live a decent residential life in a pleasant and stable dwelling environment protected against any physical or social danger. In reality, the realization of housing rights is insufficient. Public support private rental housing is a construction or purchase house supported by the urban housing fund. Public support private rental housing, where tenants can reside for 8 years at maximum period. And the increase ratio of rent thereof after occupancy is limited to 5% per year. There are various exceptions to the special act on private rental housing. For example, It can designate a small-scale promotion district, such as a train station. There is an exception regarding the floor space index or the building-to-land ratio on Act.
In this paper, I propose the following task.
1. To expand the supply of public support private rental housing.
2. To improve and enhance quality of public support private rental housing.
3. To encourage participation of non-profit organizations, such as social enterprises and social cooperatives, in supply of public support private rental housing.
