In 2010, leading agricultural biotechnology providers - BASF, Bayer CropScience, Dow Agrosciences, DuPont, Monsanto Company and Syngenta - finalized and agreed to a process of binding arbitration which provides States with a mechanism to seek redress in the event that a Living Modified Organism (LMO) causes damage to biological diversity. This voluntary industry initiative fills a need in international environmental protection. Most States do not have substantive or procedural laws specifically addressing biological diversity-related claims, whether based on existing known threats to biological diversity or biotechnology.
