국가경제가 활성화되고 정부정책과 산업기술이 급변함에 따라 기업들은 다양한 방면에서 수주활동을 벌이고 있다. 특히 공공기관에서 발주하는 사업에 대해서 기업은 국가발전과 기업의 경영활동을 위하여 공정한 경쟁을 통해 국가경제에 이바지하고 있다. 그럼에도 불구하고 기업 간의 결합과 담합행위는 근절되지 않고 있으며 시장경제에 있어서 경제의 비 효율화, 국민경제발전의 저해 등 국가경제에 미치는 폐해가 크므로, 국가에 의한 강제 카르텔의 경우 외에는 일반적으로 각국은 금지·규제하고 있다. 정부기관들은 조달청 또는 각 기관의 자체 입찰시스템을 통하여 정부사업들을 발주하고 계약관리하고 있으며, 시장경제의 공정성을 해치는 담합행위 근절을 위해 정부는 개별 공공기관들의 입찰정보를 취합하여 담합징후를 분석하는 시스템을 계획하였다. 국내의 담합관련 규제기관은 공정거래위원회로서 입찰담합징후포착을 위해 관련 법 개정을 추진하고 입찰담합징후분석시스템을 구축 현재 운영 중에 있다. 본 연구에서는 입찰담합징후분석시스템의 필요성과 운영현황 및 기대효과에 대해서 알아보고 입찰담합사례분석을 통한 담합징후의 요소들을 살펴본다. 그리고 효율적인 시스템을 구축하기위한 모델을 제시하도록 한다.

ABSTRACT

An Information Linkage Model for Bid Rigging Symptoms Analysis in Public Agency

As national economy is vitalized and government policy and industrial technology are changing rapidly, businesses are unfolding order-taking activities in various ways. Especially for the projects ordered by public agencies, the businesses are contributing to national economy through fair competition for national development and corporate management activity. Nevertheless, illegal collusion and bid rigging between corporations are not eradicated, doing a big damage to national economy such as making the economy inefficient in market economy and obstructing people's economic development, so countries generally prohibit or regulate except forced cartel by government. Government agencies order governmental projects and manage contracts through procurement administration or each agency's own bidding system. And to root out the illegal collusion and bid rigging that impair the fairness of market economy, the government planned a system whereby bidding information of public agencies is gathered and collusion symptoms are analyzed. The agency regulating illegal collusion in this country is Fair Trade Commission, which is pushing for amendment of relevant laws to capture bid rigging symptoms and has built and is operating a bid rigging symptom analysis system. This study reviews the necessity of the bid rigging symptom analysis system and its operational status and expected effects and examines the elements of bid rigging symptoms through analysis of bid rigging cases. And it presents a model for building an efficient system.
