북한의 체제전환을 대비한 법제도정비지원에 관한 연구|RISS 상세보기

국문 초록 (Abstract)

세계사적으로 국제사회의 변화양상과 김정일을 중심으로 한 북한체제의 변동을 고려할 때, 북한은 체제유지를 위해서라도 보다 폭넓은 개혁개방을, 궁극적으로는 체제전환을 하지 않을 수 없을 것으로 예상된다. 이 논문은 이와 같이 예상되는 북한의 체제전환을 대비하여 궁극적인 사법통합을 염두에 두고 북한에 대한 법제도 정비지원을 어떻게 추진할 것인지를 연구한 것이다.

북한에 대한 법제도 정비지원을 어떻게 추진할 것인지에 대하여는 북한의 핵문제를 둘러싼 국제사회의 여건과 남북한 관계의 진전에 따라서 다양한 방식과 절차를 예상할 수 있을 것이다. 이때 미국, 독일, 일본 및 유럽연합, 국제연합, 세계은행, 유럽부흥개발은행, 베니스위원회와 같은 국제기구의 체제전환국가에 대한 지원 사례는 우리에게 중요한 시사점을 제공할 것이다.

북한의 법제도 정비지원에 있어서의 규범적 원리로서 자유민주주의와 법치주의를 바탕으로, 국제법원칙과의 조화를 이루어야 하며, 남북한관계의 특수성을 반영하여야 하고, 통일이후의 법률통합 ‧ 사법통합에 대비하여야 한다. 구체적으로는 국제기구 또는 국제적 협력에 의한 지원의 경우 지원받는 입장인 북한의 의구심과 거부감을 줄일 수 있으며, 풍부하고 다양한 경험을 바탕으로 국제적 표준에 부합하는 수준으로 정비할 수 있도록 유용한 기준을 제시할 수 있다. 이 경우 남한은 국제기구 등에서 북한을 지원하는 재원의 일부를 담당하거나 북한과의 교류협력, 개성공단 입법경험 등을 바탕으로 국제기구의 회원국 또는 특별 구성원의 자격으로 북한을 지원하기 위하여 구성되는 국제기구의 분과에 소속되어 북한의 법제도 정비에 있어 주도적인 역할을 담당할 수 있을 것이다. 이외에도 남한이 단독으로 지원하는 방안으로서 남북교류협력의 활성화를 통한 간접적 지원, 남북합의서 체결 등을 통한 직접적 지원, 개성공업지구와 금강산관광지구의 법제도 정비지원이라는 방식이 가능할 것이며, 통일과정에 대비한 법제도 정비는 물론, 통일 이후의 남북한 법률 ‧ 사법 통합을 위한 조직적·제도적 준비도 필요할 것으로 보인다.

한편, 일본은 풍부한 재원과 아시아의 체제전환국들에 대한 지원 경험을 갖고 있으며 남북한과 인접한 국가로서 일본과의 협력을 통한 북한 법제도 정비 지원을 고려할 필요가 있다. 남한과 일본의 협력에 의한 북한 지원은 체제전환국가에 대한 인도적 지원이라는 명분은 물론, 남한의 경우 일본의 자금을 이용하여 통일 이후까지를 내다 본 북한 상부구조의 청사진을 실현할 기회를 가질 것이고, 일본은 인접 시장의 확대와 통일 이후의 남북한에 대한 영향력 확보라는 실리를 취할 수 있을 것이다. 다만, 일본이 아시아의 여러 체제전환국가들을 지원하는 목적에 대하여 과거의 군국주의적인 지배에 이은 새로운 형태의 경제적 식민지를 확보하고자 하는 것은 아닌가 하는 우려의 시각이 존재하며 일본과 협력할 경우 일본과의 불행한 과거로 인한 나쁜 인상과 통일 및 미래국가 형성에 있어서 일본의 개입 가능성에 대한 남한국민의 부정적 시각이 존재할 수 있으므로 협력의 매 단계에서 이러한 우려가 현실화되지 않도록 전략적인 대책도 아울러 요구된다고 하겠다.

북한의 체제전환과 평화통일 과정을 대비하여 북한의 법제도 정비를 지원하는 시스템을 구축하는 것은 남북통일의 규범적인 측면에서의 기본원칙과 기준을 제시하는 것으로서 남북한 교류협력과 통일 이후의 법제도통합을 위한 지침을 제공함으로써 신속하고 효율적인 남북통합의 완성에 기여할 수 있을 것이다. 이러한 목적을 달성하기 위해서는 다양한 분야에서 법제도 정비지원에 대한 기준을 통일적이고 종합적으로 체계화하는 것이 필요하며, 향후 북한의 정치적 변동, 남북관계의 진전 및 국제사회의 통일여건의 변화에 따른 유동적인 상황과 여건을 고려하고, 부단히 발전적인 현실을 반영하여 새로운 모델을 창조적으로 준비하여야 할 것이다.

The North Korea is expected to initiate open policy in the economy area, to enlarge a drastic reform in politics and social systems to maintain it's regime, and to expand to transition in the long run. This thesis aims at assistance of legal systems to prepare for transition of North Korea. This could be very helpful to integration of legal and judicial systems after unification of South and North Korea.

It would depends on the given conditions related to an international politics concerning Korea Peninsula and the special relationship between South and North Korea how to assist tuning up legal systems of North Korea. In this course, it would be useful to study the cases in which The united states of America, Germany, Japan, and international organizations including UN, IBRD, EBRD, The Venice Commission have assist other transition countries.

The North Korea ought to transit for the peaceful unification policy based on the free and democratic basic order and rule of law. The assistance of legal systems in transition of North Korea should be formulated and carried out in the same normative principles. These principles could comprehend a trait of the special relationship between South and North Korea and be in harmony with international law. These normative preconditions in the process of assistance of legal systems in transition of North Korea could make it achieve successful integration of legal and judicial systems after unification of South and North Korea.

It would be considered as one of useful plans to assist legal systems of North Korea to make use of international organizations. They have various experiences and could give us helpful instructions in assistance legal systems of North Korea. But South Korea ought to play a decisive role in the process of assistance in the way of participation in the international organizations as a member of them. Besides, South Korea could independently assist North Korea in various ways like carrying out inter - Korea exchanges and cooperations, concluding mutual agreements, especially assisting legal systems in the Gaesung industrial complex and Gumgang mountain tour area.

Japan has been rich in resources and has much experience in assistance legal systems of asian nations including China, Vietnam, Cambodia, Mongolia and so on. Japan consider that unification of South and North Korea would seriously affect the future of Japan. In this mean, South Korea and Japan have common interests in that matter and could work in close cooperation in assistance of legal systems of North Korea. However, Careful attention must be paid to the fact that North Korea has a strong antipathy to Japan on account of history.

The establishment to assist legal systems to prepare for transition of North Korea could show normative standards in the process of unification of South and North Korea. This contribute to the maintenance of peace and stability on the Korean peninsula as well as in the East Asia and to the prompt integration of political and social unity. This is why to create and develop effective models in assistance of legal systems of North Korea.
