私的売春に対する定期的性病検診の導入と実態 ‒内務省衛生局史料および山梨県の事例分析を通じて‒ = The Adoption and Reality of Regular STD Screening for Private Prostitution Business -Through Analysis of Ministry of Home Affairs, Hygiene Bureau Historical Materials and Yamanashi Prefecture Cases-

本稿は、内務省衛生局史料と新聞･帳簿史料を基に、山梨県における私的売春営業者に対する定期検診の成立過程と実態を全国的文脈の中で分析するものである。山梨県の検診は、警察主導ではあるが、保健組合を介した間接的手法で運営され、全国的にも典型的な事例のひとつに位置づけられる。こうした間接的手法が用いられた背景には、公娼と私娼の法的区別とそれにより発生する矛盾の影響があった。本来ならば、私的売春は認められないものである。にもかかわらず、私娼に性病検診を課そうとすればその営業をある面で認めなければならなくなる。組合による性病検診の運営はこの公娼制度との矛盾を緩和するものであった。しかし、それゆえに受診率低下や私的売春許可の誤解が発生するといった問題も生んだ。花柳病予防法により、私的売春営業者への検診が明記されたのは、こうした矛盾を法律により踏み越えようとする試みであったと考えられる。

This paper analyzes the establishment process and actual practices of periodic health examinations for private prostitution operators in Yamanashi Prefecture within a national context, based on records from the Ministry of Home Affairs’ Health Bureau and newspaper and ledger sources. While police-led, Yamanashi’s examinations were operated through indirect methods via health associations, positioning it as one of the typical cases nationwide. The background to the use of these indirect methods lay in the legal distinction between licensed and unlicensed prostitutes and the resulting contradictions. Private prostitution was fundamentally not permitted. Nevertheless, attempting to impose venereal disease examinations on unlicensed prostitutes would, in a sense, necessitate tacit recognition of their business operations. The union’s operation of venereal disease examinations served to mitigate the contradictions within this licensed prostitution system. However, this also led to problems such as declining examination rates and misunderstandings about permitting private prostitution. The inclusion of examinations for private prostitution operators in the Venereal Disease Prevention Act can be seen as an attempt to legally overcome these contradictions.
