한국의 반덤핑 조사와 대상 물품 선정의 문제점 = Issues in Korea's Anti-Dumping Investigations and the Selection of Subject Merchandise

국문 초록 (Abstract)

한국의 반덤핑 제도에서는 반덤핑 조사대상 및 부과대상 물품의 범위와 관련된 실무적 불명확성, HS 코드에 기반한 물품 선정 방식의 한계로 인해 일부 상품이 부당하게 포함되거나 제외, 덤핑방지관세 부과방식에 있어 수입신고가격을 비고려, 중소 수입업체들이 반덤핑 조사에서 대응하지 못함 등이 문제로 지적된다.
이러한 문제를 해결하기 위해 본 연구는 다음과 같은 개선 방안을 제안한다. 첫째, 덤핑방지관세 부과대상물품에 대한 사전확인제를 도입하여 조사 대상 물품의 포함 여부를 명확히 하고, 불필요한 분쟁을 줄일 것을 제안한다. 둘째, 기존의 정률세 부과방식 중심에서 물품 특성을 반영할 수 있도록 기준가격 부과방식을 보완적으로 도입할 필요성이 있다. 셋째, 관세사와 산업 전문가로 구성된 전문팀을 운영하여 물품 선정과 조사 과정에서의 전문성을 강화하고, 더 신뢰할 수 있는 결정을 내릴 수 있도록 한다. 넷째, 중소 수입업체를 대상으로 한 정보 제공 플랫폼과 법률 자문 서비스를 구축하여 조사 과정에서 적극적으로 대응할 수 있도록 지원한다.

This study evaluates Korea's anti-dumping investigation system, highlighting challenges in selecting and excluding goods under investigation and proposing practical improvements. Ambiguities in selection criteria and procedural uncertainties often lead to disputes, undermining credibility and effectiveness. Key issues include unclear definitions of like products (diverging from WTO standards), limitations of HS code-based selection, disregard for import declaration prices, and insufficient support for small importers.
To address these challenges, the study suggests: implementing a pre-verification system to clarify goods' inclusion early, adopting price-based criteria for accuracy, forming expert teams of customs brokers and industry specialists, and creating information platforms and legal support services for small importers.
By analyzing EU and Japanese cases, the study explores how pre-verification systems and refined definitions of like products could benefit Korea. It aims to enhance the fairness and efficiency of Korea's anti-dumping system while balancing domestic industry protection with international trade compliance.
