포용적 국토발전을 위한 국토기본법 개정방향 = Directions for revision of Framework Act on the National Land : in relation to UN Sustainable Development Goals(SDGs)

국문 초록 (Abstract)

본 논문은 현행 국토기본법이 변화하는 국토환경과 사회의식을 반영하여, 제반 국토정책의 방향성을 제시하고 지침으로 기능할 수 있기 위해서는 주요조항의 개정이 필요하다고 주장한다. 구체적으로, 국토와 관련한 국민의 권리, 국토정책의 기본원칙 등을 분명하게 제시하여 기본법으로서의 위상을 강화할 필요가 있다. 개정방향과 관련하여 핵심적 가치로서 포용적 국토발전을 제시하는 바, 이는 유엔 지속가능발전목표(SDGs, 2016~2030)의 도시와 정주지관련 항목에서 강조되고 있는 것이기도 하다. 도시와 정주지이용과 관리에 대해 대안적인 관점을 내포하면서, 동시에 국제적으로 제도화된 기준을 제시하는 SDGs와 해비타트III 새로운 도시의제 등을 적극 활용하여 국토기본법의 개정방향을 구성해보고자 한다. 또한 기본법개정에서 주요 키워드로서 국토에 대해 국민이 갖는 기본적 권리라는 의미에서 ‘국토권’에 대해 시론적으로 검토한다.

다국어 초록 (Multilingual Abstract)

The paper argues that the present Framework Act on the National Land need to be amended in order for the law to provide directions and guiding principles to all sorts of National Territorial Policies reflecting the changing national territorial environment and social consciousness of people. Specifically, rights to national land, basic principles for national land policy should be clearly provided to strengthen the Framework Act’s presence. The vision of Inclusive national land is considered as a key value for the directions for revision of the law. Inclusiveness is also emphasized in 11th goal about cities and human settlement among UN Sustainable Development Goals(SDGs, 2016~2030). The paper, thus, attempts to concretize the direction for revision, utilizing SDGs and New Urban Agenda, HabitatIII. Besides, the concept of ‘Rights to National Land’, a keyword implying the new ideology of the revision as a basic right of people is examined.
