COVID-19 has been spreading in Korea since the first confirmed case on January 20. Accordingly, the Korean government has been implementing various measures in line with the spreading trend of COVID-19, focusing on prevention and quarantine in addition to the treatment of infected people.
These governmental measures to respond to COVID-19 have brought about a variety of constitutional debates from the beginning of the implementation, starting with the disclosure of movement of confirmed persons and close contacts to a group gathering ban due to currently reinforced social distancing rules. In particular, when the government issued an order of prohibition on group gatherings in accordance with Article 49 (1)-2 of the 「Infectious Disease Control and Prevention Act」 to respond to the increase in COVID-19 infections after the National Liberation Day rally on August 15, it triggered a constitutional debate of whether or not the restrictions on basic rights guaranteed under the Korean Constitution, such as freedom of business, freedom of assembly and freedom of religion, were appropriate.
Therefore, it is necessary to clarify the constitution in order to resolve the social confusion. In an ordinary situation where the current spread of COVID-19 is not considered, there can be no disagreement on the fact that the government’s prohibition on group gatherings is an unconstitutional measure.
However, the aforementioned basic rights can be restricted under Article 37 (2) of the Korean Constitution, and the current situation caused by COVID-19 applies to the need for national security, maintenance of law and order, and public welfare, and if it is implemented in accordance with Article 49 (1)-2 of the 「Infectious Disease Control and Prevention Act」, the government’s order of prohibition on group gatherings is bound to be a legitimate measure. Yet, even if the government’s regulatory measures are constitutional, there may be controversy over whether it violates the essential aspect of the freedom or right stated in the latter part of Article 37 (2) of the Korean Constitution.
Until now, Koreans have become a global example by voluntarily and actively cooperating with government measures to overcome COVID-19. Nevertheless, in the midst of a situation where COVID-19 is not ending and the spreading trend continues, many people are complaining of fatigue, and the current exhausting debate needs to be resolved if we consider the circumstances in which we are facing economic difficulties.
