Korea’s marine biodiversity is the world’s highest level (the number of marine species in Korea’s waters is 32 species/1,000㎢, which is said to be the world’s No. 1 per unit area). The range of fisheries genetic resources is very wide. It is expected that utilizing the traditional knowledge of marine fisheries that has been accumulated for a long time will also help in discovering the marine and marine life industry materials that are widely used in various fields such as pharmaceuticals, health food, and cosmetics production.
The genetic resources of marine organisms have different chemical and biological characteristics of natural products compared to oily organisms, and there are restrictions on accessibility and collection technology for living organisms, so the level of research and development is far lower than that of terrestrial organisms. Appeared .Moreover, in light of the quality and quantity of biological resources, tropical waters have been insignificantly developed to date, mainly because they belong to developing countries with limited scientific research and development capabilities or to small island countries. Korea, which lacks marine genetic resources, is opening a new horizon for marine genetic resources and related traditional knowledge through the adoption of the Nagoya Protocol.
It can be expected to enhance the protection and management of genetic resources in the country of use, such as regulating the export of genetic resources originating from the approval of genetic resources as a state’s right, and inhibiting indiscriminate overuse and exploitation. In addition, before the Nagoya Protocol came into effect, profits generated by using genetic resources could be maximized, including intellectual property rights, but in the future, after this Protocol came into effect, it would benefit the countries and donors that donated the genetic resources. It has to be limited because it has to acknowledge the sharing.
This paper examined the background of the adoption of the Nagoya Protocol for legal review of marine genetic resources and traditional knowledge, reviewed the main contents of the Nagoya Protocol, and the World Intellectual Property Organization(WIPO) on the protection of maritime genetic resources under intellectual property law. And the recent discussion trends in WTO/TRIPs related to trade and suggested future revisions to the patent law.
