憲法制定의 正當性에 관한 硏究

다국어 초록 (Multilingual Abstract)

Most of the Korean Professors think that the principle on the legitimacy of the establishment of constitution is introduced by A. V. Sieyes and accomplished by K. Schmitt. And those two scholar's opinions are all on the issue of the legitimacy of the establishment of constitution. But the legitimacy of the establishment of constitution should be the problem of today, not of the past. The legitimacy of the establishment of constitution has to be estimated by the recent principle of legitimacy.
Until the 20th century, human history developed the principles of legitimation through the friction of two opposing values, for example, the friction between the traditional legitimacy and rational legitimacy. However, we notice that these opposing principles of legitimacy were amalgamated in the 21th century. And we may amplify this principle into the following three subcategories: democratic legitimacy, procedural legitimacy, and objective legitimacy.
Therefore, the objective of this study is to suggest the concrete contents of these three principles of legitimacy in the course of the establishment of constitution. Since the legitimacy of the establishment of constitution should be evaluated by these three principles of legitimacy. Also, when we study Korean Constitutional History, it is important to apply these three principles of legitimacy.
