A legal dispute over the ownership of an iron meteorite (approximately 14 kg) that fell near Enköping, Sweden in November 2020 was ultimately settled by the Supreme Court of Sweden (Case T 3007-24, August 19, 2025), following proceedings through the District Court and the Court of Appeal. The central legal issue concerned whether the meteorite, newly fell from outer space, constitutes a component of real property (fast egendom), or whether it should be regarded as a personal property (lös egendom) and subject to acquisition by occupation (occupatio) as a res nullius (ownerless object).
The District Court held that the meteorite was an ownerless personal property and recognized the finder's acquisition through occupation. The Court of Appeal reversed this decision, extending the concept of “land” (jord) under the Land Code (Jordabalken), and concluded that the meteorite should be considered part of the land, thus belonging to the landowner. However, the Supreme Court overturned the appellate judgment and reinstated the District Court's ruling, holding that the meteorite did not constitute an intrinsic or permanent component of the land (such as clay, gravel, or bedrock) and therefore was not included in real property. Since the landowner neither knew of nor exercised control over the meteorite, possession had not been established, and the finder's acquisition by occupation was therefore recognized.
Regally, the Supreme Court reaffirmed the boundary between real property and personal property based on the criteria of intrinsicness and permanence, and applied the classical doctrine of occupation-based acquisition to a modern context involving an object of celestial origin. The Supreme Court also clarified that the right of public access (allemansrätten) guarantees freedom to use nature but does not serve as a direct legal basis for determining ownership.
However, in a dissenting opinion, Chief justice Anders Eka argued that the meteorite should become part of the land immediately upon impact, thus belonging to the landowner. This view has been criticized for weakening the requirements of physical integration, permanence, and possessory control.
The decision supports finder ownership, which may strengthen incentives for exploration, reporting, and scientific research, yet it also raises concerns over speculation and unauthorized export of valuable meteorites. Accordingly, a hybrid regulatory model is proposed — combining finder rewards, a public pre-emption right, and a registration and reporting system. From an international trade perspective, clearer ownership standards enhance predictability in cross-border transactions, insurance, transport, and research cooperation.
In comparative law, the decision aligns with the general principle of acquisition of ownerless property by possession under Germany's BGB §958, Swiss and Japanese civil laws, as well as with the continental European trend recognizing personal property status where there is no substantial attachment to the soil. Through an analysis of the decisions at each judicial level, this case illustrates the need for a balanced legal framework that reconciles scientific research incentives with public preservation interests in the emerging space age.
