난파물제거협약(안)에 따른 국내법령 연구 = A Study on the draft Wreck removal Convention and the related National Laws

다국어 초록 (Multilingual Abstract)

International Maritime Organization will be proposed to adopt Wreck removal Convention through the 2005/2006 diplomatic Conference after considering the Convention by 90th session of the Legal Committee.
This Convention consists of 22 Articles with preamble and apply to wreck in the Convention area which means the exclusive economic zone of a State Party. Major contents of the Convention are reporting wrecks, determination of hazard, locating wrecks, marking of wrecks, measure to facilitate the removal of wrecks and financial liability for locating, marking and removing wrecks. As national law in relation to the Convention, there are the Public Order in Open port Act, the Marine Traffic Safety Act, the Public Water's Management Act, the Aids to Navigation Act, the Marine Pollution Prevention Act and the Sunken Vessel Management Order. The aim of this article introduce the draft Wreck removal Convention and compare the Convention with the National Laws and provide how to accept the Convention to national law.
