소수자의 인권 보호와 인권의 상대적 보편성 = Protection of Minority Rights and the Relative Universality of Human Rights

국문 초록 (Abstract)

세계인권선언(The Universal Declaration of Human Rights, UDHR)이 1948년에 국제연합총회에서 채택되고 많은 국가에서 받아들여진 이래로 전 세계에서 인권 보호를 위한 정책적인 발전과 함께 개인적인 노력이 함께 이루어져 왔다. 하지만 여전히 인간의 기본권에 대한 보호, 특히 사회 취약 계층 중에서도 소수자의 인권 보호는 국제 사회의 가장 시급하면서도 달성하기 어려운 과제로 논의되고 있다. 소수자가 경험하는 다양한 형태의 차별과 배제는 많은 개인 및 집단에게 삶의 질 보장 문제뿐 아니라 생존의 문제를 안겨 주고 있다. 인권에 대한 선언과 인권 보장의 현실 사이의 요원함, 그 중심에는 인권의 보편성과 상대성 논쟁이 자리 잡고 있다. 본 연구는 인권의 보편성과 상대성이 이분법적으로 이해되는 상극의 개념이 아니라 인권을 설명하는 두 가지의 구분되는 성격이며, 상호 비판이 아닌 상호 보완을 통해 실질적인 인권 보호를 위해 고유한 기여를 할 수 있다는 논지를 제시하고자 한다. 특히 잭 도널리가 제시한 인권의 ‘상대적 보편성’에 초점을 맞추어, 인권의 성격이 어떻게 이해되어야 하며 소수자의 생존 및 삶의 질 보장을 위해 인권 존중이 어떻게 삶에서 구현되어야 하는지 논의하고자 한다.

다국어 초록 (Multilingual Abstract)

Since the Universal Declaration of Human Rights (UDHR) was adopted at the United Nations General Assembly in 1948 and accepted by many countries, there has been both policy development and personal efforts worldwide to protect human rights. However, the protection of basic human rights, especially those of vulnerable social groups and minorities, remains one of the most urgent and challenging tasks discussed in the international community. The various forms of discrimination and exclusion experienced by minorities present not only a problem of ensuring quality of life but also a matter of survival for many individuals and groups. At the heart of the gap between declarations of human rights and the reality of their protection lies the debate over the universality and relativity of human rights. This study argues that the universality and relativity of human rights are not diametrically opposed concepts but rather two distinct characteristics that describe human rights, and that through mutual complementation, rather than through criticism, they can make a unique contribution to the substantive protection of human rights. In particular, focusing on Jack Donnelly’s concept of ‘relative universality’ of human rights, the study seeks to discuss how the nature of human rights should be understood and how respect for human rights should be implemented to ensure the survival and quality of life for minorities.
