사회보험법과 사회보장기본법 = 사회보장기본원리에 입각한 현행 사회보험법제 검토

국문 초록 (Abstract)

헌법상 사회보장의 기본원리로는 사회국가원리, 사회적 기본권, 국민의 인간다운 생활을 할 권리와 국가의 사회보장 및 사회복지 증진 의무, 사회연대의 원칙 등을 들 수 있다. 사회보장기본법은 이러한 사회보장의 기본원리를 토대로 하여 사회보장 및 사회복지와 관련된 개별 법률들을 지배하는 기본원칙과 공통원칙을 정립하는 법으로서 제정된 법이다. 사회보험 관계 법령 역시 헌법상 사회보장 기본원리에 의거하여 사회보장기본법상 원칙에 따라 제정, 적용된다. 이러한 원리에 비추어 볼 때 현행 사회보험법은 특히 사회보험 사각지대, 사회보험의 물적 적용범위, 사회보험 재정, 일과 가정의 양립을 위한 제도와 관련하여 개선과 보완이 필요하다.

다국어 초록 (Multilingual Abstract)

The fundamental principles of social security of Constitution are the principle of the social state, social right, the human rights to a life worthy of Human beings, the duty of state for the improvement of social security and social welfare and the principle of social solidarity.
The framework act on social security is a legislation enacted for the establishment of the basic principles which govern several acts on social security and social welfare on the basis of the the fundamental principles of constitution. Social insurance related Acts are also according to the framework act on social security on the basis of constitution. Considering those principles the current social insurance law should be reformed with regard to the exclusion, the application and finance of the social insurance and the system for the work and life balance.
